sale of property

Hi,

I have sold my property to a builder for rupees 41.40 lakhs under just a sale agreement on Rs 100 and took a due of 3 months which are going to end on 1st of jan now due to dispute in my family we are not willing to sell the property we have recived EARNEST MONEY rs 5 lakhs and we are ready to return it can i cancel this agreement its written in agreement that i cannot sell the said property to any onelse other than the builder .

I am also agree to go with deal if the builder provides me sum of ruppes 60 lakhs i want it to increse the sale amount can i do so

i still have papers and the orginal doc. of property like u no. chaltha no. plan copy . but i dont have SANATH of the property its also written on the plan that its proprty belongs to maharashtra shashan and possession is with us

i still live there

what should i do to cancel the agreement ? or to get the amount increased and the bulder is not ready to give

Regarding under value of the suit property

The property belongs to Delhi and at present the market value of the suit property is Rs. 57 lacs. If the property is undevalued by one of the legal share holder then the suit can be rejected under Order 7 Rule 11(b) of CPC or an amendment petition can be submitted in the concerned court afresh and related judgements.

Pecuniary jurisdiction

The total cost of the suit property as per Delhi Government circle rate is Rs. 57,72,888. The property belongs to three class I legal share holders. Kindly specify the pecuniary jurisdiction of one legal share holder as well as the requisite court fee to be submitted in the concerned court and where the case is to be be filed?

Also specify whether the case can be dismissed under Order 7 Rule 10 of CPC being without pecuniary jurisdiction or whether an amendment petition in connection with pecuniary jurisdication and fees can be submitted afresh and related court orders?

ILLEGAL CONSTRUCTION IN DDA FLATS IN DELHI

I reside in ground floor of D.D.A. SFS flats in DELHI.

The owner of top floor in my building has done alot of illegal permanent construction on the roof.

I have filed R.T.I. against this illegal construction but with no concrete action.

I,therefore,request you to guide me "How should I move further and where to appeal" against this illegal construction.

If I file an application against this illegal construction in COURT then:
(1)What will be the expenditure incurred on me?
(2)How should I do it?
(3)What will be its implications?

can a gift deed be revoked by the heir of a donor?

Hi,

My father (who has now passed away) was gifted a small piece of land and the donor too has now passed away. Unfortunately none of the heirs of the donee have got the title transferred in their name. Now the son of the donor has filed an application to take back the land that was gifted, on the ground that none of the heirs of the donee have transferred the property. Is this tenable?
A quick response will be highly appreciated .

NRI buying Poreperty in TamilNadu

Dear Lawyer Team,

I am currently residing in Canada. I wish to buy the property in my home town dharmapuri, India. Is there a way for me to reigster the house in my name while being in canada? or is there a way to give PoA to my younger brother who is in chennai,tamil nadu.
I heard from a lawyer that recently they changed the law and wherever the property registeration takes place, PoA shud be registered there (in that ciry). Is it true?

Share of married daughter

Dear sir/ Madam, We are jain hindu by religon.Got married in 1990. My wife had a grandfather who baught property in grandmothers name in 1975 who was house wife. After both passed away two daughters of grand father had their name on rights of record.Before demise of grand mother she adopted one son of one of her daughter, after demise of grand father. now my wifes mother wants to sell and encash the share in the property. What will be % of my wife s share in the property?
