INCOME TAX

SIR, ONE OF MY CLIENT HAS BUSINESS INCOME MORE THAN 10 LAHKS (RUPEES TEN LAKS). IS HE REQURED TO AUDITED HIS ACCOUNT IN THE ASSTT.YR 2009-2010? I HAVE SOME URGENCY, PLEASE CONFIRM IMMEDIATELY

Income Tax on TV Game Show

Whether, to levy and collection of Income Tax from the Winner of Prize money
from any T.V.game shows prior to the amendment in the I.T Act in the finance Act 2001, does not contravene

1-Art. 265 of the constitution of India, as there was no text " any winning from T.V Game show.

2. Section 136 of the I.T. Act, as without
any evidences that T.V.Game show was
comming within the ambit of 'game of any sorts'as mentioned in Section 2(24)ix and 115BB, where as from Section 115BBA, it is clear that, particular games are listed u/s 115BB.

3. And, the CBDT Circular- 447 of 1986

SALES TAX

ONE OF MY CLIENT WHO IS REGISTERED WITH UP TRADE TAX ( SALES TAX ) HE HAS NOT BEEN FILING HIS VAT RETURN SINCE 2006 ONWARDS HE DOES NOT HAVE ANY SALE AND PURCASE DURING THE SAID PERIOD.

WHAT SHOULD HE DO NOW HE WANTS TO SURRENDER HIS SALES TAX NO AND WANTS TO GET DONE ASSESSESSEMENT OF THE SAID FINANCIAL YEAR.

CST 1% OR 2%

HI,

I HAVE PURCHASED GOODS FROM INTERSTATE AGAINST C-FORM.

I HAVE BEEN CHARGED CST @ 1% AND @ 2% WITH DIFFERENT SUPPLIERS IN DELHI AND OTHER STATES.

I JUST WANT TO CONFIRM WHAT IS THE RATE OF CST NOW AGAINST FORM -C . IS IT 1% OR 2%.

Service Tax Applicability for UPgradation of Civil Hospital

I would like to inform you that we have got one composite contract for upgradation of Govt Civil Hospital valuing approximately 10.0 Crores.It includes the value of Medical Equipment valuing 4.0 crores and labour,materialand plants covers the rest of value.We have not considered service tax components as the intention of the contract seems to be for social cause, however, there is no such mentioning in the contract as the rate includes all taxes/duties. Please clarify whether service tax is applicable for this contract and if so, how to minimise the same as we have not considered the component. Anticipating early reply from the experts.

ITAT Tribunal rules..

I have to defend an appeal at ITAT .Can anyone please answer my queries..
1.In paper book form one has to file all those papers and evidences which one had filed before the assessing officer and CIT Appeals . Can one file Brief history of the case along with the paper book as it was not part of the the papers filed before the lower authorities.
2.Do one needs to file compilation along with paper book or can one file it later.

Section 54 and transfer and acquisition of residential plot.

There are exmptions cited under sec-54 for transfer and acquisition of residential house property. Deos this also apply to transfer and acquisition of residential plot?
