MACT and IPC

Today a one bike rider just hit my 2 vehicle for the back of my vehicle onto this a unacceptable arguments was said by the offender. Although not any damage to occur to my vehicle but a disrespect was hurt to me and I noted the Number of vehicle and afterwards got the address of offender from the RTO office in local district.

Now I am planning to file two cases

1. MACT under S.166 but a problem is that my 2 vehicle was not insured under S.196.
WIll it create problem to get recovery of amount under Sec 184 MACT. without need of FIR. // matter of District judge jurisdiction
OR
In what sections of MACT I'll have to proceed for getting compensation for damage to 2vehicle (while not informing the accident by the offender under S.134 MACT.)


2. A Crl.case of S.279, S.323 and S.506 IPC direct complaint under Sec 190 CrPC. NO need of FIR // matter of C.J.M jurisdiction

Is there any time limit for conducting auction by the bank after taking possession of the property under sec 13(4)0f SARFAESI ACT? How long can the bank charge interest after taking possesseion ? Can they charge interest after taking possession and not conducting auction till 4 years?

CENVAT

We are having two manufacturing unit one is 100% EOU & anther is Non-EOU and both are availing CENVAT. Non-EOU is transferring some (Electric Cabales) goods to 100% EOU with payment of Excise Duty. There are two questions:-

(1) Non-EOU procured cables with paid excise duty at the time of purchase and if they are transferring can they charge Excise duty at the time of transferring/dispatch goods to 100%EOU.

(2) 100% EOU can avail CENVAT against the same.

Please guide us with reference of relevant Notification/Circular.

costruction of house

sir,
I am 22 years old and my mother and me are willing to build a house in a plot given by my grandfather
in andhrapradesh.Since we had been brought up in a different state I do not know anyone in that place( my father has expired).
We have no own house and do not have any idea about constructing house before.Most of our neighbours are telling that
it is difficult to beleive in most of the contractors since they might cheat and nowadays it is not good to rely on word of mouth.
I do not want to sell the plot due to sentimental reasons.
Can you kindly suggest me how to find a reliable contractor and whom i should approach to take sugession in construction
i.e., if there is some place where we can get the information and guidence about standard contractors and architects.
the plot is in ponnur(guntur district)and also please inform me if I should appoint a lawyer and make agreement with the
contractor.

Stamp Duty on Deed of Guarantee

Dear Experts,

Please let me know the rate of Stamp duty payable on Deed of Guarantee.

We are advised that as per the latest notifcation in June 2009, it is 0.2% of the Loan Amount. It is mentioned that since there is no Specific mention about the Deed of guarantee in Bombay Stamp Act, it is taken as 0.2%.

Request please clarify on this issue, also give us the rate that is applicable.

Society is not signing form for CIDCO NOC

Dear Sir, I am buying resale Property in Sanpada,navi mumbai
Registration is done on 16th Sep,09,

being gaonthan plot Society has to sign some document to take CIDCO NOC, and society's people are not signing the papers.

need your help how we can short out the matter,

Pre closure charges on Home Loans charged by Banks.

Are you aware that there is a Supreme Court order dismissing a Special Leave Petition filed by a Bank against the refund it had to give its client fo such pre payment charges. The Hon Supreme Court observed after hearing both the petitioners that it would not interfere against the order to refund the preclosure charges against the Bank.
In another order a Bank has been asked to refund Rs 64,80,000/- (Yes Rs 64.80 lakhs) collected as pre closure charges from a party WITH Interest till the date of refund of the amount.
My query to the Appellate Authority of Reserve Bank of India, Smt Usha Thorat, in an appeal filed by me, under the RTI Act along with a copy of the Hon Supreme Court order and the directive by the Reserve Bank of India keeping this order in mind is yet pending reply. This appeal was filed about 15-20 days ago. Original query under RTI was filed in August.
