Foreclosure charges

I want to know whether a settlement by an insurance company in case of totalled car to the financing institution comes under prepayment category or not and can the institution levy charges for that or not. Thank you for your responses in advance

Preclosure charges on total loss car

I purchased a car on Nov 10 2023, on Dec 5 2023 due to floods it was completely drowned and was declared a total loss. Upon informing the bank I was asked to close the loan and go for a new loan if I want to buy a new car. I asked them to get the new car hypothecated with the same loan but they denied it and asked to close the loan. Now when the insurance company is paying, they are also demanding 5.21% as foreclosure charge. I also mentioned them that I have taken a new loan for the same amount from them (Kotak Prime) but still they are asking me to pay additional charge (5.21% + taxes, around 1.5 lakhs).
I have raised this in Ombudsman but Kotak Prime is replying the same even after that.

If anyone could help me with this I would be very grateful and thanks in advance

Day care centre on rent

I have my own kothi in Delhi so I'm planning to give my one floor on rent to "Day care company" as tenant, So please tell me what all formalities or norms which is important for me and there should not any issues by Police, MCD or NDPL.

Please guide.

Co-operative housing society maintenance charges

Our society registered in 2013 and there after no elections. Also not conducted the AGM after 2019. The society doesn't have chairman or legal committee. Most of the society members are paying maintenance charges but some defaulters are not paying as society committee is not legal. Is this correct? Do we have any law to bind them to pay maintenance charges for which they are availing all the services?

Respected Sir / Madam,
I have following queries –
1. State Information Commission to dispose of my 2nd Appeal (RTI) called hearing just few days before lockdown started due to COVID-19. I arrived the Commission in time. But, because of any unknown reason, hearing was not happened. I was verbally informed that pending hearing will be happened later in a due date which will be informed later. But, till today no hearing is called. In last 04 months, I did write two registered letters to the state information commission praying an earliest hearing. They are keeping mum. Original RTI application was done in April, 2018, following 1st Appeal in time, 2nd Appeal to information commission was done on 01.10.2018.
Till today, I did not receive any information letter from any public authority also.
Without going to the High Court, which central government office/department can help me for an early hearing by the state information commission to dispose of the RTI application ?

2. In state government diploma engineering colleges, many Lecturers in different subjects were recruited violating the norms of the AICTE denying eligible one. They don’t have minimum qualification even for recruitment in such posts. All diploma engineering colleges in India must comply the norms framed by the AICTE. Which central government agency can investigate this illegality / scam ?
3. Examining authority of Diploma engineering system (autonomous body under state government) is not paying huge money in crores as remuneration for different examination duties to the different employees since 2009 or earlier. Which central government agency can investigate this scam ?

Complaint against reporting officer before magistrate

Sir/Madam, I seek your esteemed advice on whether a subordinate can file a complaint before Magistrate for adverse remarks in APAR/OPAR with reference to INTEGRITY where in the officer without following any procedure laid down in CCS (Conduct Rules) to fill the Integrity Column directly made the adverse remarks as "To Be Monitored". So far 6-years passed the authorities have not initiated any action on the subordinate nor on the Reporting Officer against the representation made by him. Can I submit an appeal before Magistrate t for the suitable action against the Reporting Officer? Can the Impugned adverse remarks may be quashed by the Lordship?

Key facts have been given below.
1. Ponneri police Inspector c Martin Premraj who has been jailed twice by Tamil Nadu Govt, has called my sister for enquiry based on.a complaint she has sent against 2 ladies who have picked up quarrel with her.
2. To conduct an enquiry C Martin Premraj called my sister & 2 ladies at 5.30 evening.

3. Inspector c Martin Premraj did not conduct an enquiry till 9.00 night . at 10.30 Inspector has asked my sister to go out of police station without conducting an enquiry. She left police station at 10.30 Night on 08.12.2021.

4. The ladies who have misbehaved with my sister have also been sent out of Police station at 10.30 night.

5. I understand that ladies should be allowed to stay in the Police station from sunset to.sunrise.

6.If the ladies stayed in Police station, Inspector c Martin Premraj must inform Inspector general of Police north zone as per the law.

7. I sought the information under the RTI act asking the copy of letter sent to Inspector general of Police north zone in which my sister stayed in Ponneri police station up to.night.10.30.

8. The Inspector general.of Police north.zone.didn't give the information under the RTI act 2005.

9. I made an appeal to.IGP north zone.

10. He did not give reply for appeal.petition.also.

11. I have made second appeal to.Tamil Nadu state Information commission.


12. They have files case No.& called for enquiry.

13. I want to know the legal act No. Section which asks the Inspector of police to inform about the night stay in the police station.

Apartments - builder vs owners

Dear Sirs,
Greetings.

On behalf of the Apartment Owners Association, we have asked our builder the following docs associated with our apartments building

1. All the electrical drawing/diagram submitted by the builder to the elec board and their approval
2. All the structural drawings submitted to the municipal authority and their approval
3. All the water piping/ connections drawings submitted and the approvals
4. All the interior and exterior painting details of the building in which Asian Paints provided a 10 yrs warranty for the painting as we understand from the manufacturers rep.
5. Relevant drawing and approval of Sewage Treatment Plant.
6. All the submitted and approved drawing/diagram of the Fire & Rescue eqpt system installed and approval docs
7. All the relevant diagram drawings and docs of Rituculated Piping system installed for LPG supply to the entire flats
etc.

But the builder is not interested to handover most of the docs. They have informed us that the drawings and diagram of electrical connections, gas connections, structural premise diagrams/drwgs, water piping etc. are not available and so can not handover!!!

Among the other docs, painting has been done by subcontractor and so the details are not available. If reqd some of the Bill's or invoices can be arranged but not all the full details. On Warranty part, the builder is not aware of that and informed no warranty on painting or paint products. ...........
Their response is in such a style as mentioned above.

So, our query is whether as Owners Asdociation we do not have rights to ask and have those important docs mentioned here s above? If they are denying, what sort of step we can take to have thos docs? RTI will help us ? Or on legal point of view, what can we do here? From which Govt. authority, we will get supports on this regard?
