Illegal acts of Court Ameens

In a Rent Control proceedings, on reaching finality, eviction order was passed and the Ececution Court has ordered for Delivery of possession of the petitioned premises. After several round of Litigations, the High Court of Madras has confirmed the eviction.

80 year old Decree Holder(Landlady) paid batta for the same and police protection application was also ordered.

The Judgment Debtor have approached the Court Ameens and made some arrangements for delay of delivery of possession.

The Ameens are delaying the delivery day by day by saying several reasons that Petitioner to be present to obtain police help, No rule to take possession on Saturdays, Police on election duty and returns the batta.

Decree Holder has paid batta several times.

New Ameen appointed and they also coping hands with the previous Ameens

Now Decree Holder has photographs when Ameen came to the office of her counsel.

What can she do againt the Ameens? What is the remedy for her at this old age ?

Promissory note

Dear experts,

I would like to know whether a promissory note should be executed on a stamp paper, if not then what is the procedure.

Also as an individual can I legally lend money to someone on a monthly interest and make a mention of the interest rate on the promissory note.

Also please guide me with format of a promissory note.

Succession Certificate / Legal Heir Certificate

Dear Members,

Could you guide me in letting me know the following.

1. Will the court issue Succession Certificate or Legal Heir Certificate.

2. My client has approached the local MRO but was asked to obtain Legal Heir Certificate from Civil Court.

3. But will the civil court issue Legal Heir Certificate. Normally, it will issued Succession Certificate.

4. Please let me know the documents and other formalities format if possible to apply to the civil court for obtaining the Succession Certificate.

leave and license agreement

for how many years is it safe to allow a particular tenant to reside in a property?

i m about to renew my L&L agreement for another 11 months now, as the first agreeement for 11 months is due to expire.

* i am wanting to know how many times can i renew the L&L with the same tenant?
* is there any risk to renew the L&L more than 2 times if the tenant is ready for an increase of 10% in license fee after every agreement.?

POWER OF ATTORNEY

My son resides at Bengaluru. He wants to execute a power of attorney POA in my favour for completing formalities of purchase of property in Gujarat like signing agreement to sell, sale deed, registration etc etc. He needs to notarise and register POA at Bengaluru.

Pl let me know if my presence is required for registering POA at Bengaluru or not. Advocate at bengaluru has advised that I should be present during registration of POA at Bengaluru. Pl also confirm if Rs.100/-stamp duty for POA executed in Karnataka is correct and what is registration fee for registering POA at bengaluru.

i am consumer?

I am whole sale distributor of medicines. I sent one courier containing some medicines to retailer but that courier was never reached to retailer. Can I filed complaint before consumer court (If yes, please cited some judgments) or I go to the civil courts for recovery of damages.

stmaping of document & signing on it

Normally, Any document which requires stamp duty, is first stamped by way of franking, and then signed/executed.

I have a query that i had an agreement which was formed by two parties. Due to mistake, one of the party signed the document before it could be franked for stamp duty. The document got franked thereafter, even through it was signed by one person. The other person signed that document after franking.

Whether such document remains valied or it needs to be corrected


My Second Query is Whether a Gerneral/Special Power of attorney concerning to carry out a business, has to be "COMPULSORILY" Notarised ? or such document without notarising is a valid and enforceable document.

A shop was purchased by my elder brother in the name of my minor son,now i want to transfer (sale)this property to my sane elder brother,my son is still minor & shop is standing in his name,how i can sale this shop on the behalf of my minor son,is their any prior permission of the court is required for sale,i & my wife are natural guardion Parents of our minor son.plz help

Validity of Stamp Papers

Hi All:
Do non judicial stamp papers have a validity or an expiry date?
Till when can I use the stamp papers purchased on 1st May 2009?
