validity of unregistered document.

Respected Seniors,

Whether the Tenant file an injunction suit basing on the unregistered agreement deed ( i.e. 100/-. non judicial stamp paper ) for restaining the Land Lord for peacefull possession and enjoyment of the tenant with in lease period.

If it is possible please mention provision and citations for validity of the said unregistered and insufficient stamped lease agreement.

consumer forum or state commission

hi
i need to know if an employee was working in gurgaon i.e not in delhi i.e in haryana, but the employee resides in delhi, he has some dispute with the company for PF dues can he file the case in delhi, in haryana or directly to state commission delhi, as going to haryana needs lot of time and not possible for him, can the juridiction lies where he is residing, i do also need to know where is the provident fund tribunal in delhi, can the case can be filed there? thanks>

provident fund juridiction

one employee is working in sales profession in delhi , the company in which he was employed is based at bombay, the company has no office at delhi, the company has not setteled the P.F of the employee , the emoloyee has writen to P.F. dept. mumbai but did not got any reply, how can he get his P.F dues as going to mumbai and contesting his claim is very difficult, what is the remedy?

Consumer Protection Act Question!!

Hi All,

I have a typical situation. I had filed a complaint against a builder in State Consumer Forum for deficiency in service and unfair trade practices. The State Commissioner recorded my consent (wrongly) and passed an order to return back the property and the builder will return back my money within 2 months and didn't grant any interest or compensation. The builder didn't comply the order and in the meantime, I filed a revision petition in National Forum saying that the consent was wrongly recorded and I need interest and compensation. In this petition, I didn't ask for any stay on the order of State Forum.

Now can i file an execution petition in State Forum for non-compliance of the order as there is no stay on the State Commission's order and I am just asking for additional compensation and interest in National Forum.

Please advice as I don't want to keep that property anymore.

advocate refused to give no objection on vakalath

My counsel denied me to give no objection on vakalath. I filed a leave petition and requested the court to allow me as party in person.
My question is should I file vakalath nama as party in person with the petition or not. Pelease inform me immediately.

Clash between Bank & CTO

Dear friends,
Bank has moved under securitization act, against a bad debt for recovery. When the matter is at the stage of auction, CTO has sent a notie to Bank by informing their dues along with penality.

My question is CTO has a right to move against party for recovery of dues along with penality, but when Bank holds 1st charge over the said property, then can CTO can claim penality from the Bank or not. As of my knowledge CTO can claim Dues only but not penality.

Please resolve and give ciations if any!
