Hindu law Conflicts with 1850 Act.

India is a secular State as we all know. If so,that section 13 and 13A of the Hindu marriage act of 1955, is a direct conflicts with Caste Disabilities Removal Act of 1850. As the 1850 is not confined to propriety rights alone but all other personal or non propriety rights including conjugal rights also. therefore disruption of the matrimonial rights of any spouse on the ground of religion only is unreasonable.
Moreover,if the converted spouse is committed to the matrimonial obligations despite conversion is it a ground for divorce? If so, its a bad law.

Tenant refusing to vacate

One person has been occupying my shop for the last 35 odd years. His business is collecting scrap. He has not paid rent for more than 3 years. The rent paid before that was also a paltry Rs.250/- and that too paid irregularly.

And he has become a nuisance with dumping all the waste material coming to his shop in the drain channel which runs in front of the shop and our house. These waste material blocks the drain and all debris flows out during rainy season causing foul smell and dirty water all over the place.

There is no written agreement with him. He has been promising to move out for the last 6 years. The man has many other shops of his own. Now he is arrogantly saying he will not move out.

My wife is planning to start a stitching centre and we need this shop very badly.

Can someone advise me what sort of action should I take to get this man evacuated?

Arbitration proceedings - withdrawn . What is next possible alternative

we have specific arbitration clause relating to settlement of disputes between contractor and institution.

on non payment of installments institution sent notice to recover the amount with opportunity to hear. but not availed and no amount paid.

we cancelled the contract

contractor failed to challenge amount due or act of ours to cancel the contract

we invoked arbitration clause and withdrew as requested by us to do so on ground that we can recover under land revenue act
. and arbitrator allowed it saying to exhaust other remedies first before coming to him


now we started revenue proceedings and contractor is opposing it on ground of arbitration clause..

plz help

suit for damages

I was filed a criminal complaint against two accused peersons before the judicial magistrate under section 420 etc..Unfortunately I failed to produce the required evidence against the accuse and the court discharged the accused without framing the charge against them and dismissed the case.Lateron the accused persons filed suit for damages before the civil judge sr.dn.against me.Can the accused/plaintiff will be succeeded against me?
