regarding rights

Dear all,

I and my friends were sitting in local garden/park yester evening 15 th august. Some police officials came and started evacuating the garden/park. One of my friends asked the police inspector, why is he evacuating the park?? The police inspector and other policemen started beating my friend. Is there any procedure to bring down that policemen on knees????

Under constitution 226/227

My client has obtained a home loan without creating any security interest/mortgage deed. The financial institution has sent notice U/s 13(2) and 13(4) of SARFASI Act and has approached the Magistrate Court U/s 14 of SARFASI act for physical position.

My client has contested the case in the Magistrate Court, which has been accepted.

Before issue of any order from the Magistrate Court can my client file a writ for a stay.

Doctrine of merger

High Court dismissed the 1st appeal confirming the lower/ trial Court judgement. But High Court did not give any finding on the irrelevant issues framed by the lower/ trial Court, which were questioned in the Appeal.

In the Supreme Court, the SLP(Civil) filed against the dismissal of Appeal was dismissed as "no merits". On filing the Review Petition, the same was dismissed as "no apparent error".

Please inform the Constitutional Remedies available.

Regarding ambit of Art.32

1.Can a Supreme Court order perceived to be affecting adversely numerous subordinate legislations namely state rent control laws be asked to be set aside under Art 32?
2.Can the person affected directly in the first instance by the impugned supreme court order have the locus standi to move this application under Art.32?

Writ against govt. officer of govt. company

Respected sirs ,myself is a govt. servant working in Govt. company i e state electricity transmission company......my query is can a writ can be filed agaist Divisional officer of our company to fix responsibility for , arbitrarily using his powers , misinterpreting the circular of company and based on that misinterpretation of circular , neglecting to disburse dues of some working and some retired employees , unnecessarily causing delay in getting guidance from higher authorities when circular is clear cut to understand.

Fact of case -
for employees who are appointed under OBC catagory , govt. of maharashtra has made mandatory to submit caste validity certificates before granting them benefits of GO II , leave encashment after retirement etc..........circular is very clear that it is mandatory to employees who are appointed under OBC quota.......but local officers are applying this circular to employees who are not appointed under OBC quota i e who are appointed under a scheme absorbing Nominal muster roll employees to company employees . the scheme was implemented in 1979 , 1081 , 1nd 1983 .........under this schemes many employeess of OBC birth , who were working on nominal muster roll were taken as company employees.........this appointment was under a decision of company then ......it was not appintment under OBC catagory ........even as per my knowledge , OBC reservation , quota started in 1992 ......but these appointments are happened in 1079 , 81 , 83 i e before OBC reservation started...........still local officers have not disbursed the dues of these employees , demanding OBC validity from them.....Higher authority is also not taking decision on this isssue .......matter is pending since one year......we want to file a writ in mumbai HC for this injustice ........can we do it directly ?....what will be cost for it ?? what is remedy for employees ????/ pls GUIDE

Is graduation is mandatory for any job in indian contitution, in other word if any one asks
for graduation for any job is it uncontitutional ??

Complaint against sp officer (maharahtra)

yesterday we went to the local police station akola for seeking a help from where we were forwaded to the SP office, so we went there, there we were asked to write our need in an application , so we did the same, his subordinates there (dont know name and post but were in khaki wardi) read the same, on asking wheteher we can get help he said yes SP will help you. we were asked to keep our phone out so we did the same.
then we entered, the television in his room was on and politely stated our need and gave the same application.
for no reasons known the SP started abusing us it was me(21yrs) and my mom (55yrs)there, frist he said in a loud tone and denied helping, he then scolded us and threatned us and said i will sue you for wrong charges, then he specifically used the term "bloody" in full aggression and anger we were actually very scared as he had power.
thene he said "shutup and get out " three times. we were shocked to see his this type of attitude ,then a female not in any uniform( wardi) entered , he ordered her to " take her out of the room and said her to slap my mom twice and reapeated by saying dat lady this is my order to u slap her twice and throw her out" den he kept shouting for no reasons .
we left from der.
i dont thnk a SP OFFICER can ever talk to commom man the way he did

now i want justice
whom do i ask justice for ???
where do i complaint he is the SP der???
and i dont have any recording also that everythng happened in front of the othe officers der but they were quite and shocked as well less chances that they will help us in anyway. but i need justice people like him are not worth the post they get.

About non compliance of services

I am doctor by profession and I got answers from the experts on this site the site is very valuable tool for me.
I am not victim of administrative delay.Bombay nursing home registration is required to run hospital.I am already having reg.for my old hospital and applied for reg on 13/3/2013 and taken receipt.The tahasildar and legal advisor (Unofficially )raided hospital and Civil surgeon after order from Collector(Not Appropriate Authority)put F.I.R.onme
Now my query is that can I put any civil case on clerk for not forwarding my application to respective office? I have already made complaint one month back to civil surgeon and I have taken video shooting of the clerk saying he has forgotten to comply with.

psu ban on campus recruitments (constitutional law)

Sir , As per the judgement of the Honourable high court of Madras, case no 29832/2011 pil filed by petitioner Palanimuthu, the high court had earlier ordered status quo but in Aug 2013 it removed the ban on campus placements until final hearing .I want to know supposing if anyone files a case in some other high court(lets say delhi high court or UP high court) regarding the same matter but against some other psu ,will that case be acceptable to the court or they would wait till the decision of Madras high court .And i want to know is it possible that one high court bans it but other high court allows it .And if yes whom will the psu follow . I am no expert and am sorry if i made any mistakes while writing this. Thanks
