Joining without relieving letter

Hi

I am selected by a xyz company its want me to join with in 15 days. In the current company I am having 8 weeks notice period. Already after getting offer in xyz company I resigned and am surviving notice period too. I completed 2 weeks already, But am trying for early relieving but they are not even responding to my mails. Am done with my KTs and all. I Don't have dependency too.

New company they won't wait Upto 8 weeks if I can't join they will cancel my offer letter.

For me this job is very important. Bcz current company situation is not good. They planning to close soon but not revealing officially.


Please suggest me what I have to do.

Ccs pension rules

Respected Learned Experts. I am Central Government employee who had been compulsorily retired subsequent to a departmental enquiry. There was a criminal case pending at the time of my compulsory retirement on the same grounds of departmental enquiry. I had been paid with provisional pension as per CCS (Pension) Rules after compulsory retirement. Thereafter, I had been convicted by the Trial court under Cr.PC. Now the conviction order was stayed by the High Court as I had preferred Criminal Appeal. Subsequent to my conviction, my department has issued me a show cause notice for reduction in pension. Now an order of reduction in pension to 40% was imposed by the under secretary of Government of India. Whether penalty of reduction in pension be imposed when the grounds of the departmental enquiry and the criminal case was one and the same. The department has already retired me compulsorily and now reduction in pension on the same set of facts based on the conviction order by the Trial Court is permissible in Law. Please clarify.

Reversion of promotion from higher to lower post in central

i have been promoted to group b gazzted post from non gazzeted post in central govt deptt..but due to some family and health issues i want reversal of promotion..is it possible to take reversal.. our promotion is done on ad hoc basis

I’m working under health and family welfare department Himachal Pradesh in RKS contract as staff nurse. There is one year left to complete the contract. Now I selected in AIIMS. There is need of NOC or not.kindly explain.

Non-payment of salary

Dear Sir,
I worked for an Hyderabad IT based company from Nov2019 to June2020. The company has not paid me salary for a period of 2 months+Bonus as agreed. They gave me all relieving letters when i left in June. They promised they will pay the salary pending salary, but keep on answering emails saying that hthey will pay when they get money from clients. Till today single paisa not paid sir. Kindly let me know if I can send a legal notice.

Notice period for resignation for permanent employee ct. gvt

is there any provision of notice period before resignation for permanent employees of central govt? or it can be accepted immediately?

Employer kept my car forefully

I used to work in a company and they gv me car for my private use. Also cmg and going to office. At the time of resignation.the director of the Company has kept the car forcefully with them and also told me to keep the keys of the car only then they will gv me clearence certificate. Nw the car is with them and smbody is using it unlawfully but it is still registered on my name.
What should i do..also no police station is registering FIR for the same... where should i go and file a case. And what will be the jurisdiction of that court? Can i file from the place where i m residing? Or where company is situated?

The Payment of Gratuity Act 1972 inter alia states:
Payment of Gratuity.- Sec 4 (1) Gratuity shall be payable to an employee on the termination of his employment after he has rendered continuous service for not less than five years,-
(a) on his superannuation, or
(b) on his retirement or resignation,
(c) on his death or disablement due to accident or disease: .

1st query is what is the legal difference between superannuation(a) and retirement(b)?

2nd query is : If a person removed/terminated by the decision taken in board meeting from his service (on the ground of his physical incapacities due to over age(87 years, he join this company at the age of 70 years)) can the person be eligible for claim gratuity? Is his termination by the order of the Board fall under head of (a) Superannuation or (b) retirement, resignation?

Hra during eol without medical certificate

is hra applicalble on extra ordinary leave taken without medical certificate in central govt..plz specify the rules regarding this issue
