Eviction of shops in residential area.

Dear Sir,we have a residential house in kanpur and few shops as part of the premises.there is no agreement done or no receipt given for the rent as the place was given on needful grounds, only 2 shops had a casual written agreement of 10 years which has already expired .
How to approach to take back our own premises.
What preparation should we do before resorting to any legal action?
Any way by which we can peacefully resolve this issue?

How long it might take if case taken to court?

Avoiding registration of two wheller

4 months ago i sold my two wheeler to a x person, I have received all the money,but now the problem i face is Mr. x person avoiding to register the vehicle in his name from last 4 months i requested a lot but still he is avoiding , i don't understand what to do , is there any solutions so that legal i will be safe,i made notary but some lawyers opinion that notary has no value so is there any one who help me in this case what to do ?

ryt of my step mother and her son on our ancestoral property

My father had two wives. The first wife is my mother who have two daughters one is married and another is unmarried. The second wife have one son. my father died on 3 june 2015. I wanted to know how our ancestoral property will be divided as second wife is illegal.. my father married the second lady 20 years ago and our ancestoral property is in gautum budh nagar (u.p).

Acquittal in ipc 417/376

Dear Sir,

This has regarding to my last query regarding trial of IPC 417/376 for one of my friend.

Thanx for your earlier advice. My friend has been acquitted from all charges (IPC 417/376) level against him without any benefit of doubt on 21/05/2015 at Trial court as prosecution was not able to give evidence of IPC 376 and 417.

Now I have three quires

1.0 Maximum time limit for prosecution/Complainant to file review petition at high Court from date of Judgment at Trial Court.

2.0 Maximum time limit for acquitted accused to file defamation case from date of Judgment at Trial Court.

3.0 If acquitted accused loses the defamation case will there be re opening of case under IPC 376/417.

Your valuable advice will be very helpful for us.

How to stop promoter for construction building

Respected Sir, property was original purchase by father of A:B:C:D from Z(saler) in year 1934 but till now property was not complete mutation due to some internal problem and present L.R record was still in name of Z(saler)....A:B:C:D an there father has died & Z(saler) also died.....present legal heirs is 13(person) all son/daughter of A:B:C:D....out of 13 person 11 person are handover property to promoter and promoter will complete all paper work including mutation etc....but remaining 2 legal heir denied for construction building due to property was still unpartition situation but promoter threated this 2 legal heir person and said they will construct building by taking up 11 person share and remaning 2 person share will left vacant. Sir my question is that can this 2 legal heir person stop promoter for construction building by filing an injunction against property and also can this 2 person ever get injunction from court because property recent record was still in a name of saler and property registration title deed was in name of present legal heir grandfather. Mention property belong to muslim & presently whole property was utilizing some tenent.....Sir please help and reply as soon as possible...thanks you.

Contest divorce case after agreement of mutual divorce on stamp paper

There is a divorce case applied by wife (in Canada) through POA holder(wife’s father) against husband u/s.13(1)(ia) (Harassment) in family court. Husband is contesting divorce case because he doesn’t want divorce. During the divorce case, Husband made fake facebook account of his wife without her permission. Wife’s father has applied complain in Cyber Crime Branch for fake facebook account of his daughter. Cyber crime branch has not made FIR against husband because wife’s father and police department has put a condition to husband that if husband ready for mutual divorce then they will not make complain against husband for cyber crime and will take the complain back.
My question is, if wife’s father gets permission of mutual divorce from Husband by made agreement on Stamp paper then it is final concern of divorce? Court can permitted divorce in concern of permission on stamp agreement. Can husband contest the divorce case although he had made stamp agreement of mutual divorce in future?

Plea to prepone the date of bail in high court

Dear sir/ madam
My brother has been charged with 420 ipc and sentenced 2 year imprisonment in a fraud of land case by session court. Since then we have done compromise with the other party, paid them full amount as demanded and submitted the compromise to the high court with plea for bail. On first hearing in high court, He was given a next hearing date of 4 th feb and on 4 th feb given yet another date of hearing 20 march though court accepted the compromise affidavit. Since then my fathers condition has deteriorated and brother is the only male member of the family who can help with his condition. We want to request court to prepone the next date of hearing and release my brother from the prison. He has been in prison now for 1.5 months inspite of the compromise. Please guide if the plea for preponing the date of hearing will be the right step and what are chances of this being successful. Thanks a lot.

Appeal in supreme court

Sir

Our petition for quashing of FIR has been dismissed by High Court saying that we shall have remedy to make my pleas before trial court.

We want to appeal against the orders of High Court and get the FIR proceedings stayed.

What is the procedure and chances of the stay of FIR while proceedings?
