Against rejection of marine claim, which remedy is faster and cost effective; National consumer forum or civil suit. can we challenge the same before high court through writ petition.
I have filed a case in a consumer court. The opposite party has filed a vakalat stating who is representing them. After that they are not even appearing in the court for any hearing and the judge too is just giving ajournments in one month periods. So far 5 such adjournments have been given. According to Consumer Protection Regulations, 2005 and even a Supreme Court Order in the case of Civil Appeal No. 7975 of 2001, it has been clearly stated that the opposite party can have only a maximum of 45 days to file their version. In this case they are not even appearing, let alone asking for adjournments. What can be done by me to inform that court that they have to now decide on the case or take the next step?

In 138 N.I.Act Notice, the word liability or debt should be mentioned in the notice, further, dues from the accused mentioned notice is it suffucient for 138 N.I.Act notice, please comment on this.
Whether any case is pending for decision before the Supreme Court on the point - Whether the services rendered by an advocate to his client in the course of litigation be covered under the provisions of Consumer Protection Act

There is a recent supreme court decision that no courts either civil courts, family courts or high courts have the power to waive the statutory period of 6 months prescribed u/s.13-B. There is a very recent Bombay High Court decision laying down that where the couple have been living separately for more than one year, insisting upon statutory period is not unwarranted. My query is on what ground the Mumbai court hold differently than what is laid down by the supreme court.

The documents available with me as below.
1) Registration Card.
2) One hand written medicine details (shortly)while referring me to his senior doctor who is located at Pune.
3)My history/Details of past treatment etc have been noted by that Pune based doctor & copy of the same is available with me.
4)CASE Papers - Prepared by Pune based doctor.
5 Payment receipt for Rs.1300/- two times paid to that doctor.
Is it possible to go ahead with these supporting documents.
Please advise.

I had this severe pain in my right hip joint and I showed it to an orthopedic Sargon. He suggested MRI. Which I got done, after looking at the MRI the doctor said I had some effusion (accumulation of puss) in my joint which needs to be aspirated (taken out). He aspirated my puss and sent it for culture and sensitivity in the pathology, and meanwhile started my treatment with ATT (Anti Tuberculosis Treatment). The Gram Staining report which was received immediately, suggested I did not have Tuberculosis, but still the ATT was started. After 6 weeks the report of culture also came up, which again suggested that there was "No Bacteria seen and there was no Growth of Bacteria". My severe pain was not subsiding at all, but my orthopedic surgeon kept insisting on tuberculosis. After 8 long months of continuously taking ATT and the pain still not subsiding, I showed my hip to another orthopedic, who suggested another MRI. After the second MRI report, second doctor said I had AVN (Avascular Necrosis) and not Bone TB.
Now, experts, I want to know if there is any such case which has been settled earlier. I would greatly appreciate if anyone could help me on this.
