Request to experts.
Sir,i would be pleased to hear your comments.
She is my cousin.
She is born with her elder brother,one elder sister & one younger sister.
Her father died of cardiac arrest last month with out writing a TESTATE.
Her mother is alive & she wants to bequeath the entire property (MOVABLE & IMMOVABLE INCLUDING CASH BALANCE) to her son.
Now my cousin continues the rest.

Coming to my brother ,he has two wives.
First wife left him after eight years of marriage along with her lone daughter to her parents place.
After lot of persuasion to his first wife,
he married another woman as his second wife without taking divorce from first wife.
Can the first wife have any claim in the our family property.
Now coming to the point,can we sisters have any claim over a portion of our father property.
We don't like to waste our time,dragging our brother & mother to court,if our claim doesn't hold any legal backing.
Here both my brother & mother are opposed to give us any share.
Since my father has not made any TESTATE before his death,do we sisters have any right to approach the court.
Please advise us on this regard for which I would be highly obliged.

Dear Sir,
We are a muslim charitable Organisation having received an immovable property from a donor by way of HIBA. The HIBA had been recorded in the form of an Affidavit which had been duly notorised but not registered. Please advise how to get the Property Tax and Patta transfered into our Organisation's Name. What rules should we quote to the concerned authorities to get the name trnasfers done. We shall be very obliged for your kind advise. Thanking you.

for mother there 6 brothers given 3 acres of agriculture land by register gift deed signed by all 6 brother in 1986 (the original gift deed kept with them only ,they have not given to my mother )..recently in 2009 my mother given to me by register gift deed registration over (without having original gift deed) the same said in the registration deed also.. she is not having original document at the of registration)i have taken pat-ta book, pass book,also....now my mother brothers given me court notice ...saying that ..this was illegal registration, because the elder brother (among 6)(expired 5 years back) was not willing to register the land to my mother.so the registration is illegal? so, now what i should do ? weather my registration stand"s ?? if any previous judgement u have can u post me sir

(1)what is the procedure of applying probate in mumbai high court, it is simple or complicated
(2) an individual having the good knowledge of legal documents can apply himself for probate in the high court or for applying the probate, help of an advocate is must
(3)one of the advocate to ehom i have talked about the probate is demanding his fees rs.65000 is it reasonable for this kind of work because i am unable to pay this much of amount as fees.
(4)is the consent of all the legatees or beneficiary for probate is must or court will sent the notice to all the beneficiaries or will send to all the legal heirs.
(5) if court will send the notice to the legal heirs than what is the time limit of the notice.
(6)if heirs are living out of the mumbai
or out of the state than their notarized consent in relation with the Will from their living place is valid or not.
(7) if the executor not applying for the probate than how the other legatees can challenge the Will since right of probate lies only with the executor and on the basis of the notarized consents executor
has already distributed the properties of the Will to all beneficiaries and those properties have been already transferred and some of them have been sold out.

sir i passed my graduation in 2010.But in my third part exam i used a cheat in one of the honours paper and by mistake i left cheat in the copy although i am not a bad student in terms of study but there some reason due to which i had to use cheat in the exam.when i saw the results i declared pass with 64% in grad.i want to know that will this incident can cause problem for me in future and affect my job.At present i am working in SBI as a single window opereator.
