Under RTI ACT

There is a property in Rajender Nagar Sahibabad Ghaziabad 6 MIG flat was there.

Half of the partition we are all using as Parking half is covered by builder he leave as it after sale of all the flats one of the flat owner claims that he was buy this area and i have registry of that.
He started construction in 2008 after that all 5 member make a complain to GDA and in the Map of GDA it is approved for Parking.
GDA was broken the Constructed Area and the matter closed.

He now putted Mat carton over there and still showing his possession on that.

Is there any Rule / RTI information to treat such kind of people.

How can we get information related to valid documentary proof rather than GDA map that is now sold or that is a parking area.

sir my sister is got widowed in aug 2010 his father in law is having ancestral property in Haldawani Uttarakhand my sis has no issue is my sis can claim her rights on property & home her husband was the only son rest 3 are sisters 1of them is not married can u pl help me

Very Interesting Case

1. A lady "allegdely" files for divorce under Section 13(1)(ia) on grounds of cruelty.
2. 4 months later , she and her husband submit a memorandum of compromsise under Order23,Rule 3 where she agrees to divorce, no maintainance and also giving up custody of her children aged 3 & 4.
3. The court passes an order the very same day under sec13(1)(ia). Surprisingly the decree is drawn under sec 13(b)!!
4. 3 months after the order is passed the lady one day notices the divorce order in the house which is when she realises that what fraud has been played on her. Till now, three months after divorce order has been passed, she is still living with her "husband".

This seems like a mockery of the laws. Is this a valid order/decree at all?Does the indian judicial system have any provision have any recourse for this lady?Or is the story over? What is the procedure now available to have this divorce decalred null and void?Can some of the sharpest legal minds in the country shed light on this matter.

Dress code of Advocates.

Many of the countries had dropped the advocates formal robes, they are using the normal office dress code (shirt and tie). Any body filed any case for the similar change in India.

Rent Control Appeal and Stay

Tenant sent rent by money order to the land lord. Landlord refused to received the money order and filed eviction petition (RCOP).

No notice issued on the tenant.

Dispute over the rent amount and period to be paid was raised in the court. Court passed interim order to deposit rent amount as per the agreement in force. Tenant deposited the money as per the interim order and was depositing every month without fail.

Court held that there is a will full default committed by the tenant. Court also held that the period and the amount of the rent arrears claimed by the Landlord is right. The court had not directed the tenant to pay the difference of amount. Erroneously decided that the interim order was not complied, because the court had not seen or called for the receipts deposited in the treasury. But, ordered eviction.

RCA filed. Stay petition is also filed. Interim stay not granted, stating that the tenant has to deposit the rent arrears. But the Stay petition and RCA pending.

1. What is the rule for getting interim stay?
2. Whether the tenant has to deposit money, even though he was complying with the interim order of the lower Court?
3. Whether the tenant has to continue depositing rent as per the lower court’s interim order?
4. Whether the appeal before High Court is possible for denying the interim stay?
5. Whether the land lord can file EP?

A person knowingly issued a cheque with wrong signature and take a loan from his friend. now, he malafidly not returning the amount and the banker has written the cheque with remark "signature differ" please guide and also provide drafting,if any available.

Parents will be legal heirs or not?

Last month my younger brother died in an accident. he was married last year, no kid. In one of his insurance policies his wife is nominee, in this case his parents will be legal heirs or not for claim amount?
