WILL THE BORROWER LOOSE HIS RIGHT RIGHT TO APPEAL U/S 17 IF HE DOES NOT APPEAL WITHIN 45 DAYS. IN THIS CIRCUMSTANCES WHAT SHOULD BE DONE.
there was a Company which changed its registered office in the year 2010(the property belonged to a CA and he himself certified Form 18). But he is saying that in the year 2011 he asked the Company to vacate the property(but there is no notice served upon the Company) and he has issued a letter regarding the same in 2012(June 2012)to the MCA. Thereafter the Company changed its registered office in August 2012. Now the MCA has raised 2 objections-
1. that the Company has used the property since 2011 without the consent of the CA
2. the Company did not Complied the provisions of Section 146 of the Companies Act, 1956 as it shall have informed the change of registered office that it did in August 2012 within 30 days.
This is a very important matter. Please reply.

a partnership firm was enjoying OD facility from a scheduled bank against some property owning by the partnership firm ,now the partnership firm got converted to Pvt. Ltd. co.& the same loan has also got converted in the name of Pvt. Ltd. Co. against the same property which was owning by the partnership firm & still now the property owner is the partnership firm as per property deed but as per take over process it has been shown that the pvt. Ltd. co. has taken over all the assets & liability of the partnership firm , now pls suggest how ROC charge can be created on the same property which is still owning by the partnership firm as per deed & also suggest is there any issue for the bank to create charge in ROC as property deed has not been transfered or new deed has not been made in the name of that Pvt. Ltd. Co.

Can paripassu charge on promoters shares of the borrower company be created in favour of 3 banks in consortium financing. banks will hold the shares as pledge.
As per Banking regulation act banks cannot hold shares more than 30% paid up value of any company.
a company xyz ltd(transferee) has filed petition to merge with 2 other company. they have managad to get an order to dispense with the procedural requirement of convening meeting of secured creditors .an undertaking is also issued to all secured creditors and published in paper. can any secured creditor file objection to this scheme when it is before high court for sanction??
