Good Morning Sir/Madam,
My Mother(plaintiff) filed a civil case in the year 1999 for declaration of suit property. The case got ex-partee decree in the year 2001 in my mother's favor as the defendants did not appear in the court for trial.
The defendants requested the Hon'ble court for retrial of case, the court refused. The defendants went to High Court and requested for retrial by setting aside the ex-partee decree. The Hon'ble High Court set aside the ex-partee decree and sent the case for lower court for retrial. Now the status of case is for cross examination we have submitted all our evidence in the Hon'ble court and some got marked by the Hon'ble Judge.
Now the problem is the defendants challenges us to submit the Birth Certificate of mother(plaintiff) in the court. My mother born in home in the year 1970. The parent of my mother did not made any birth registration with local government (Municipality). My mother studied in the local Government School upto 7th class (Passed) and discontinued while studying in 8th class. My Mother has the Transfer Certificate given by the government school in which her date of birth and father name is mentioned.
Q: How to take a birth certificate on the basis of Transfer Certificate issued by the Government School?
Expecting early reply,
Thank you Sir/Madam.

Sir,
I was filed an shop eviction petition before rent controller,Delhi.
As per the decision of rent tribunal, eviction petition was not maintainable in law hence rejected. The main reasons gave for dismissal of petition is that :-
1. The lease deed doesn't specify any time period for lease.Hence, such lease deed shall be treated as perpetual lease deed. Therefore, such eviction petition has not been maintainable under Delhi rent control Act, 1958.
What can I do in this situation? Can I file an apple before high court against the order of rent tribunal?

Hi,
Our family owns a land of 6.5 acres at our home town. There are 3 siblings among whom this land is to be distributed by their Father(who is no more).
However, the eldest son has sale-deed 2 acres of land from the father 18 years before. So, we have a total of 4.5 acres of land left. My query to you is, will the eldest son who has already sale-deed
2acres of land have equal shares in remaining 4.5 acres of land or not in Muslim law, since he has already taken his share from 6.5 acres. If not , is there a way to not include his share in 4.5 acres of land?

The builder has delayed the possession. Can someone tell the liability of the builder? Can the buyer claim interest and compensation for the delayed period. Anything else the buyer can claim from the builder.
A is tenant in the shop. He sub let the property to his son B. Admittedly B is carrying his independent business in the shop as proprietor. A the tenant is also running his business in different premises as proprietor. there is no interconnection in both the businesses. Tenant A died pending the suit for eviction. As per definition the son B who is in possession of the shop was not doing business in the shop with the deceased. none of other legal heir was doing business with the tenant in the shop in question. what will be the position in this case? to whom the landlord should implead as heir of the tenant U/o 22 R. 4 CPC
