Co-operative society flats

In our co-operative housing society in Mumbai one flat owner was residing in Coimbatore, Tamilnadu. He died in Coimbatore a few months back. His 5 daughters, one son and widow are alive. He had made a will in favor of his son and registered it in Mumbai. His son was admitted as a Provisional member and asked to obtain a probate on the will. He now informs the society that he has applied for probate of the will in Coimbatore and will produce it in due course. Under the law probate is required only for a property situated in Mumbai and some other metropolitan cities and there is stamp duty in Mumbai to obtain a probate. Can the Society accept a probate obtained in Coimbatore for a property in Mumbai?

Certified copy of sale deed

If I have original sale deed of my property, then will bank approve loan on certified copy without asking for original sale deed, as anyone can get certified copy of others property by paying nominal fees can it also relate to a fraud

Leakage from private terrace

My flat is below a private terrace, a few years ago I got it repaired at my cost as the flat owner refused to give permission if they had to pay. However the problem has not been solved. According to byelaws 159(a) repairs of (ix) terrace and parapet wall (xxiv) all leakages of water including leakages due to rainwater (xxvii) the damaged ceiling including plaster there on in the top floor flats, on account of leakage through the rain water through the terrace.

As there is no clarity in the byelaws whether this includes private terraces or just common in terraces, could you please let me know if this would apply to private terraces also.

If it is the responsibility of the owner of the terrace flat to pay for the repairs and they refuse to give permission to carry out the repairs when building repairs are going on because they don’t want to pay for the repairs, what are the options available to us to get the repairs done?

Succession certificate after death of 3member in accident

Hi
We are facing Critical Problem to get Succession Certificate, no Advocate proper guiding us. We are Hindu & as, my Uncle died in a missive car accident with his wife, one and only son (3people died in same accident, same date). Spot death occurred of my uncle, after 30 minutes my brother died, then after 40 min my aunt died. My uncle left two brothers, two sisters. My brother was unmarried. My aunt mother also alive, she is 80yrs old. My Uncle (i.e our grandparents) father & mother died 20-21 yrs ago. Now who is the successor ? Can anyone please help us to give proper guidance ? Everyone saying its a complicated, but no one giving the solution.

Open plot purchase

Dear sir
I want to purchase 150 squad yards from a vendor who is 80 years old. He has one son, 3 daughters.
He has great grand son of age 4 years, the old man got property share through oral partition from his brothers in 2019,
In 2019 he executed sale deed to one of his son in law for the above said property, now the son in law wants to sell this property to me.
In old mans family there are four male lineages, will this become ancestral property.
There is no partition deed, family settlement deed.
If I want to purchase what precautions should I take, should I add all legal heirs as executant?
Without partition deed, family settlement deed, is it worthy to buy this property? In future will i have any litigation from them. Please suggest

Alimony and maintenance

Hi All,

I am a software engineer by profession working in a reputed MNC,my wife is a doctor (MBBS) ,we got married in March,2020.Due to some unreasonable demands of new home etc ,she left my house in the month of April 2020.Now she has filed a petition for dissolution of marriage stating that I am insane.Sec 12 of HMA .I am very much sane and will fight my case ,I don't want to go for a MCD , mutual consent divorce.I want to fight the false insanity petition against my wife and institute criminal defamation proceedings and later file a contested divorce on the basis of cruelty (after the insanity petition) against me is dismissed.My monthly earning is Rs 90000 and she works as a government doctor with a salary of Rs 30000 .We have no children and she just stayed with me ,in the matrimonial house for a month.Will I need to pay any alimony and Maintenance?.If so what would be the approximate amount if I go for a one time payment of alimony.

Illegal termination and salary not paid

Dear Expert,

Greetings!

Aditya Institute of Management Studies affiliated by Mumbai University and AICTE has illegally Terminated me on the spot without paying my salary. I would like to complain against them in College and University Tribunal. Required guidance for the same.

Please help me with the process.

Income tax earned on fd in nationalized bank by chs

Hello Experts,

Our CHS has Repairs Funds and Sinking Funds accumulated of which FD is made.

CHS has charged us share of Income Tax to be paid on that Interest Earned. I wish to know whether the Member is liable to pay? The Interest earned is going to society so the CHS must bear the Income Tax is my opinion. Kindly advise.

In case Experts are view of that each member must bear the burden of Income Tax then as a member may I suggest to CHS to keep the funds in Current Account so no burden of Income Tax for each member.

Minutes of last agm held on 01.09.2018 not circulated till

Respected sir / Madam,
We would like to seek your expert advise on the following issue......

1) The last of AGM of our Co-op Hsg Society held on 01.09.2018 but till today the minutes of the same not circulated to the members. As per Bye-laws it must be circulated within 3 months from the date of AGM to all members for their observations and suggestions if any and thereafter it has to be finalize in the MCM. Unfortunately the minutes of last two AGM's are not circulated till today and the managing committee have called the AGM for the this year - Please advise the appropriate action.

2) In the current AGM notice the managing committee has mention that .......
If it is found that there is no quorum up to 10.00 am, the meeting shall be adjourned for half an hour and this adjourned meeting shall be held on the same day and same place at 10.30 am and in such adjourned meeting the business on the agenda shall be transacted and implemented irrespective of the quorum. - We would like to know whether is this legal as per bye-laws?

Please guide us in this matter.
