Notice Period on Probation

Hi

I have a query relating to maximum notice period that should be enforceable during probation period.

I joined an IT company which went back on commitments made during the recruitment process and henceforth I resigned. I resigned within 15 days of joining the company, I was asked to serve 3 months notice period as mentioned in the offer letter accepted by me. the clause in the offer is as follows:

4. Probationary Period
You will be on probation for a period of six months and may be confirmed as a permanent associate
upon successful completion of your probation. The period of probation can be extended at the
discretion of the company

5. Notice Period
You will be required to give three months notice in case you decide to leave our services and the same
is subject to the company’s discretion. The company reserves the right at its sole discretion, to
substitute the notice period by paying you base salary in lieu of the notice period.


My question is since I'm on probation and the offer letter does not mention specifically any notice period for Probation. Does the company has the right to make me serve the 3 month notice period which I believe is against natural justice as I was just 15 days old in the organization while resigning. I have formally put the same question to the HR but have received no answer on the same.

Please advice, if there is a legal recourse for the same.

Contract Labour Act 1970


We are registered under Kerala Shops & Commercial Establishment Act, 1960. But while submitting the invoice to one of our customer, they are asking for copy of Muster Roll and Wages Register as per Contact Labour Act 1970 for processing the bill. We are not engaging contract labour in our organisation. Then how we can tackle this situation.

A line in reply would be highly appreciable.

entering name as property owner in terms of will

dear all, one of my freind's mother bequathred property situted at bangalore in favour of her son. now the mother died and my friend want enter his name as property owner in view of the will and his name should reflect in the records of sub-registrar, so that the encumbrance certificate can show his name and the property stands in his name.

kindly advice what is the procedure for getting his name in the records of sub-registrar office at bangalore.

Tax liability by gifting a property to a person who is not relative

dear experts,

I have borrowed loan from one X for purchasing of house from the housing board. the lender had given the money in the form of DD drawn in favour of the Housing board and i got the property registered in my name. since I am unable to pay the loan, I am willing to gift the property to him. in this circumstance, am I liable to pay any income tax, since I am not selling the property with any margin.

recently I read in news paper that supreme court passed a judgement stating mere demanding of dowry does not amount to offence unless due to harassment resulted in death.
