Please clarify in the below mentioned issue at the earliest

A women had a house in her village panchayat limits with clear title in her favour, she has 3 sons & 2 daughters, she proposed to sell away the property. Purchaser demanding signatures of her family members as witnesses as the purchaser doubts about legal complications to be created by her family members. Sale without family members involvement is possible and valid under law or not???///

Divorce decree

Dear Sir,
Me and my wife are on the verge of Divorce and are staying separately since Oct 2011. It’s a marriage of 14 years that we want to dissolve, due to irreconcilable differences.
Earlier she was willing to file the petition for Divorce Decree under mutual consent but now she is delaying and prolonging the affair, saying that she is not in a mental framework for the same. We had decided all the conditions for a mutual divorce together and agreed upon. All the investments were divided, joint properties sold off and the proceeds settled mutually, but now she is changing her stand on a daily basis.
I am aged 41 years and my family life, professional life, social life and financial life is in a total mess. I am unable to take any future decision for my settlement, due to this.
Kindly guide me on the matter that
“ On a separation of what duration does the Indian law allow any one of the parties to file a petition for Divorce ?”,
so that even if she does not co-operate, I can file the petition from my end.

Car accident case...

My car had met with an accident and now the case is in the court, i had filed the FIR against the person who was responsible for it. The person is from press and influential


Now my question do I have to hire a lawyer to argue for my case or would I get a public prosecutor?

Also how long will it take to resolve?

I have only 1 person as witness, will that do?

Also the other party has said, the accident was not done by her, How do i prove she had done it?

Do I have to produce false witness, which I dont want?

Dear Sir!

I m complainant saide lawyer.My client was given a cheque.. and the cheque is as " to pay self ".. so there cheque is given named as self. The cheque is not returned yet. but It is possible to get returned.

The other party purchased Goods against this cheque of 'self'. So, The complaint by dishonour of cheque of the cheque maintainable with Sec. 138 of The Negotiable Istrument Act 1881? Or The complaint to be filed under sec. 420 of IPC, 1860. as fraud by showing the cheque of self and purchased goods. then denied to make payment..!

So, which act to applicable in favour of client more effective?

accident - 338

Hi there,
I had a accident on Mumbai-Banglore highway. i was riding my bike with appropritate speed. 3-4 Women were crossing the road in such a manner that they had occupied half of the road. it was really dark on road, one of the woman was wearing burkha. I banged into one of the woman and got hurt very badly. i got and inquired them but they were did not payme any attention as they were buys checking the injuries. 3 guys came to me and asked me leave the scene as i might be beaten by mob which was slowly gathering up. I ran away 4m there. and went to clinic got initial treatment and next day i came to mumbai for further treatment. then police came to my house in mumbai and asked me to go to pune for 338 case. i requested the cops that i will come to pune but need 3-4 days to get well. so now i will be going to pune for case proceding. I dont know what should i do?

Condonation of late filing


Dear Respected Experts

The issue is: whether or not the court can be held to have implicitly condoned late filing of court process where the opposing party does not object and where the court issues preparatory orders only in respect of the merits of the case and does not mention late filing in any of those?

Proceedings by Advocate without authority

In some criminal proceedings , Mr. A wanted to move to High Court for proceedings stay against charge sheet . He discussed the matter with an advocate, paid some amount and provided him the papers. He also said to advocate to discusss the papers before submitting the papers and then he will sign the Vakalat nama/ Power of attorney. But the advocate filed the petition to High court without discussing with Mr. A and also without Power of attorney / Vakalat Nama. The pertion was rejected by the High Court. Now please advise how the order of the High Court is binding on Mr. A. Whether now Mr. A can file the fresh petition through another advocate without disclosing the filing of first petition , which he never authorised advocate to file.

partnership property

A family business is running as a partnership firm among father, son and other relatives.In case the firm is dissolved and the property purcahsed out of the partnership funds is to be distributed according to the profit sharing ratio.Can the father, who is not getting along with the son, restrain the property share to go to the son?

Can the son get a stay fo rteh above?
can the other relative partners object to the stay or get the said stay vacated?
