succession

Hello. my problem is very simple-
My grand father died with 2 sons and 1 daughter(who is my mother). Can my mother claim for a share in property?
She was married in 1987.

Opinion of experts requested

"A" purchased a property (a vacant plot) in 1997 from "B". In 1999, the seller, ie "B" has sold the same property to one "C". In 2002, "C" has sold it to "D". In 2007, these were found-out and legal notices were served. After receiving the legal notice, "D" has sold it to "E". A police complaint was given. During investigation, "B" has mentioned that by mistake he has sold the property (as per his version there were lots of plots held by him, hence, this has happened). Meanwhile "C" who bought the property in 1999 and sold it in 2002 was not traceable despite all efforts. "E" and "D" have cancelled the sale-deed executed in 2007 (in 2008).

The following action were taken to assure the rights of the original owner, ie., "A". (1) An affidavit from the concerned individuals regarding the facts were obtained; (2) By mentioning these facts, cancelling the sale deed of "A" (1997's); (3) Executing a fresh sale deed from "D" to "A" (in this deed also, all previous happenings were narrated). Since, "C" has already executed the sale deed and also the fact that he is not traceable, the above-said were suggested and carried-out.

Is the above are sufficient? Learned Experts views are requested.

Regarding Eviction order

Sir, My father is a tenant of a shop since 1961 from owner of a shop. and owner of shop is the tenant of such land. he taken this land on lease for a period of 999 years from the land owner in the year 1960. I have purchased such land from the land owner in the year 2003. Now I am the owner of land and my father is the tenant of such shop. it means my father is in possession of such shop. so please anyone can told me that how I will obtain a eviction decree against the owner of shop. please advice me and give me any citation if any. sunildatta akole, Bhusawal.

Inspection under ESI

Dear friends,


Is inspection under ESI Regulations is mandatory or the ESIC conducts it own its own sweat will.

We have last inspection under ESI done upto March 2004, after that no one has approached us from ESIC. should we contact them or wait for them to do inspection their own.

What are the main isues where there may arise additional liability.

Pls provide your inputs.

Dues and Notice pay.

Dear Hon. Experts,
Mr.X resigns from a Public Ltd company intimating it thru an email on 19th Sept 09.He also marks a copy to his HR head.The company acknowledgs the same, but not in writing.Mr X Joins a new company on 22nd of Sept. 09.Pl advise on follow:
1)Is mr X liable to pay one month salary/ or one month notice period before leaving?
2)His 21 days salary for Sept is already there with the company, hence as per work contract one month basic salary can be adjusted from these?
3)Is Mr X entitled for his Sept. 09 balance salary,Previleage leave encashments, Diwali Bonus,PF and Gratuity (for five and half years work tenure)?
4)Out of grievances the previous employer gives a public notice for mr X eight days afer his resignation, that he has been terminated from the service for fraud. Now if mr x is terminated as per the notice will he be liable for one month notice pay?
5)How can mr X claim for the dues.How can labour law solve these queries?
Please advise.

Dear Experts,
Thanks for for 1st hand information.Furter please note that mr. X had worked in the company for 5 and half years, where he was never given a single memo for anything related to work, sales performance, Account's & recovery, etc. Things popped up only after the resignation. The company's malafied intentions came on surface and they published a notice in the newspaper against mr. X defaming him of fraud, cheating misappropriation etc.Out of sheer vengience,their intention was to keep mr X away from he joining the new company.Where as Mr X Joined the new company two days after his resign.If at all his resignation was not accepted they should have sent letter of intimation to his permanent address?.Hence, it is a clear cut matter of harrasment?

cost of litigation

i want file suit against inverter battery dealer. he deliver me defected piece in rs 8000 and now donot talk to me. i have prepared the case but problem is how to calculate cost of litigation for demand.
i want teach him a lesson if any advocate want to shake hand with me then i will give him all amount of compensation received for harassment and mental agony

fraud seller

i purchased a inverter battery by seeing advertisement on news paper from local dealer of delhi gate delhi .they deliver the battery to my house rohini. at that battery is not working properly but they sad battery will take few hours to charged fully .i feel ok and then i give them rs8000 but after some days battery not working properly i call them on phone many times and they give many excuses like check water, my inverter is not working properly without even checked on phone. after some time i feel harass and i give them to go consumer court then they come i checked the battery put the food soda in the battery . but that again battery is running onlt 15 minutes backup .then i call them again they sad the one cell of battery is not working properly we will changed it but they donot come then suddenly one they come without informed me i was not in my house my wife call me i sad give them battery and take receipt in writting before giving the battery but are not come with any receipt .then i say to my wife i will come in 15 minutes wait but dont ready to wait .they sad to my wife ,we will come after 30 minutes but after that they donot come and not receiving my phone. then i send them a notice before going to consumer court but notice is come back address is not found . then i call them by become a another customer and ask for address they tell me the same address .please give me your valuable advice
