ESI Act

Under the provisions of ESI Act, if the employer provides better facilities than what is envisaged under the act ie. substantially similar or superior benefits, the employer need not get covered under the Act.

Is the PE still required to obtain the exemption under ESI Act.

our electricity consumption is low but we get higher bill amount which is sent by electricity board what we can do in our legal procceding and in what time is taken in the dispute settlement

in the accident case there is no insurance of passanger riksahw so while lodging the claim it should be avoided to join the insurance company or not ?

In a suit, there are 17 defendents. All Defts. are contesting parties.

Whether in that suit one deft. ( say No. 3 ) can ask interim relief against another defendent ( say No. 14 ) ?

There is no counter claim etc.

If yes, under what order / rule ?
If No, why ?

quantum/proportion of maintainance from the income of husban

In one of my case the Hon'ble Court passed Rs. 2,000/- as interim maintenance, without giving the opportunity to defend the husband whereas the income of the husband is Rs. 5,554/- per month. Out of whish he is used to pay Rs. 2,000/- as rent for the accommodation where he resides. Besides that there are many more expenses for daily routine. More over, he is used to come at Delhi from Surat to attend the court proceedings. Against that order I'd filed a revision petition for which the Hon'ble court had asked me any judgement or law regarding the specific quantum of the amount of maintenance for the wife out of the income of the husband. If any of my friend has plz. refer me the same. Its most urgent. Plz. Thanx in advance.

Stamp Paper Vendor Licence(Delhi)

I would like to seek some guidnace in regards to obatining Stamp Paper selling licence in delhi. This query seems unsolved for me and still stands answerable to my client. Thus I would appreciate If the panel of experts could help me out with some details as to where to apply , how to apply, requirements etc. awating for reply. thanks in advance.

Notification U/s 195 of the Income tax Act, 1961

“THE GOVERNMENT HAS ISSUED A NOTIFICATION DATED MARCH 25, 2009, SPECIFYING THE NEW PROCEDURE TO BE ADOPTED BY COMPANIES FOR EFFECTING REMITTANCES TO NON- RESIDENTS AND FOREIGN COMPANIES, UNDER SECTION 195 OF THE INCOME TAX ACT, 1961 WHICH WILL COME INTO FORCE FROM JULY 1, 2009.”


My Quarries are

(a) Whether any payment / payments made by Indian Representative (IR) to foreign principal, against cruise booking from Indian resident whether in Indian currency or foreign currency covered U/s 195 of the income tax act, 1961.
(b) Cruises are not entering in Indian Territory, whether service tax on commission received by IR, applicable.
(c) Some cruises are entering in Indian Territory, than what is the position of service tax.
