Dear sir/madam. If my parents gave me fargatti so that my wife cannot claim anything from property on the basis of child too. However its just a formality to secure ourself incase of divorce. Can they still be able to give me a share from property incase of death or can i live with them and claim my share from property or this can be reversed in future. Thankyou

Evading cooperative housing society membership for 12 years

Member Claims to be Owner of a Flat, but is evading Transfer of Certificate for 12 Years. Now...

Society is wanting to Re-Develop (Gujarat-Ahmedabad), All members have executed their Consent for Redevelopment except this so called member (unproven) and is Now holding the Society to Ransom for the Society's Re-Development.

The member is not Transferring and wants to sell directly but want to evade being a member or pay fees. But Pays Maintenance on old members name.

Is their a Solution, Law so that such members can be brought to task in a legal way by establishing that they are doing wrong knowingly. This member practices law by the way, as is currently barred as established.

What is cooling period after winning contested divorse

Couple Got married in year 2007. There is no baby from the marriage and both are salaried.
After 1 year of separation, Both boy and girl went for mutual 1st motion in Gurgaon in year 2012 court but girl backed off from 2nd motion and filed all DV/Maintenance etc cases in Delhi court against the boy and his family just before 2nd motion. Boy was supposed to pay 3L at time of 2nd motion and 3L cheque courier was rejected by the girl as she demanded 25L in women cell.
Boy filed contested divorse in Gurgaon in year 2014 and won the case in Gurgaon Court on basis of cruelty and got the decree in November after the decree. Boy couriered the cheque but it came back. Girl changed the address so the boy has filed an application in court asking court to accept 4.2L cheque on her behalf as the girl's address mentioned in divorse decree in incorrect.
When can the boy remarry? lot of lawyer says that boy needs to wait for 90 days, is it so? if yes, is it 90 days from date of decree or from date of receipt of order copy? Will Chandigarh High court put a stay on divorse decree if she go for an appeal.

Cancellation of mutation in nagarapanchayat

I have registration for 140sq yds in 2011 and I also mutated this document in nagarapanchayat records. Now the problem is my neighbour people have only 240sq yds but they had registration for 360sq yds in 2016. They applied for mutation of 360sq.yds in nagarapanchayat office. I gave a objection in nagarapanchayat against this mutation. Now I came to know that they got the proceedings of mutation from nagarapanchayat 6 months ago. But in online the name has not changed. What should I have to do to cancel the mutation of 360sq.yds

Al the outset l would like to thank all of You for your elite advice provided to the Querists

I hereby request to opine for the following case

Mr. P has three children A (Daughter) B (Elder Son) & C (Younger Son) P Expires in 2001

In Will executed by P shows that P has deprived any Inheritance to A & B and given property to his Iive - in woman _’X’ mentioning that on death of X his last "C ” will inherit the property.

Under the circumstances can this Will be challenged IS assumed that C along with X contrived to forge the Will

Why should not A & B get the share, they have equally contributed, sustaining family financially

name change

sir/madam..
I am a doctor by profession..and my home town is bhiwandi...Thane...here i gave birth to my child too...i did not change my name afer marraige..my passport also mentions my full name with my fathers name...and spouse name has been added. now wen i apply for birth certificate ..the muncipal council...they are not ready to write my maiden name in the birth certificate of my child. they say always husb name shud come after ur name post marraige. All the legal document...my aadhar ..my pan..my passport all have my maiden name...can u pls suggest me the document or laws to put forward to the muncipal council..to justify my side and coax them to make a birth certificate of my child...with my maiden name as mothers name

HUF partitioned wrongly partially 12 yrs bk, what recourse?

COMPLICATED CASE-- Hope to get good viewpoints from respected experts.

ILLUSTRATION OF CASE:

1)
HUF OF A, CALLED 123HUF CONSISTED A(KARTA), B(WIFE OF A), C(SON OF A), D(DAUGHTER OF A). Daughter in Law added as member in 1999, Let us call her E.

2)
A expired in 1999 end. Leaving behind C as Karta, and B,D,E.

3)
31/12/2004, HUF dissolved, and all assets liabilities FUNNILY distributed ONLY among B and C in personal files, who on 01/01/2005 throw their full assets and liabilities into forming new Partnership456.

4)
B,C,D again create old huf (slightly different name) in around 2008-09, by way of gift deed.
5)
B and C run this partnership456 as partners till March 2011.

6)
From April, Partnership dissolved and all business thrown into the re-formed huf as in point 4 above.

NOW:
a) Is partition under point 3 above legal (as it was partial, not full partnership)
b) If not legal, how can daughter in law E claim her rights and become part of it again or restore old status?
c) If not legal, is everything done from time of partition and later standing as null and void? How?
d) If partition was legal, HOW?

Await points of view. This is a real case scenario, is complicated and I am confused.

Change name on 7/12

Sir/madam,

My father has transferred property in equal contrubution to my self and my brother but my share has been registered wrongly as Nick name instead of original name. My all documents from child hood is on original name.Now I want to change my name on 7/12 as Original name. Kindly advice how to proceed.
