Power Of attorney

Respected seniors,
I have filed a cheque return complaint through Power of attorney holder. A wife has executed the said POA in favour of her husband to file a case but , specific reason for execution of said POA is not mentioned, now question is that, whether it is compulsory to mention reason for execution of POA?

Removal of director us 169

One company have three directors and same are shareholders. Two directors of one group have 65% shares and one director have 35% shares. One director with 35% shares of the company did not attend board meetings and was working against the company, so other directors want to remove him in EGM u/s 169. So We have sent notice of EGM to the removing director via courier and by hand also. Removing director did not receive notice by notice server and refuse to receive it. We also send the notice by courier also to the Removing Director. Courier did not come back to us undelivered till yet. We file DIR 12 but that DIR 12 not register by ROC as he says that this is case of quarrel between directors, so both parties should go to court. Now removing director taking the plea that He has not receive any notice of meeting hence meeting is invalid. Other two directors have the majority with 65% shares. What is your opinion?

Settlement deed

Respected Sir, We are two children to our mother.My mother received a property (in Chennai)from her Brother through settlement deed.But my mother registered that property in my sister's name through settlement deed without my knowledge.Do I have rights to claim that property? If so what should I do now? Can I file a case will it stand against my sister? Pls give me advice, thankyou

Need completion certificate for our flat. 20 year old constr

Hello Sir/madam
We own a flat in an almost 20 year + old society.
We purchased the flat almost 12 years ago as second buyers, had availed bank loan against it.
We have every other essential document with respect to ownership. However the completion certificate is missing.
Society is taking like forever to process the same. Thus want to process it on our own for our flat.
We are planning to sell the flat, but banks these days need a completion certificate for processing loan, thus unable to sell as prospective buyers definitely seek for home loan.
Please help.

Commercialisation of residential apartment

Hi, im residing in a apartment that has five portions .Two flats are occupied by owner including me one is rented out and remaining two apartments are rented out to a middleman who inturn furnish the apartment and use it as service apartment for short time stays for the patients in near by hospital. It is booked by patient and relatives who are getting treatmetn and people from different parts of world occupies it for short time. Below is mh problem
1.the middle man to whom its rented out is taking care of maintanence of two flats
2. The common water supply he buys water and we pay him on konthly basis
3. Any plumbing or electrical works in common area he never allows us to recommend electrician or plumber . He will have his own household maintannece guys
We need to pay what ever amount he asks for
4. In case of motor problem he ararnges them water in tubs and leave us without informing stranded for water or does some very expensive temporary solution and demands us money
5. He never consults any of the house owners
6. There is no security person appointed from his side to monitor people moving in and out
7. People who are residing in service apartment doesnt even know english or ang indian language
8. They smoke within common areas inspite of us repeadeatly telling
9. They litter the vehicles parked in the lot
10. If we raise any concern to the majntanence guy he s verbally abusing
11. People stayin in service apartment uses chemical or medicine we dont know constant get unbearable odour which prevents us from opening the main door
12 we had raised concerns to respective owners . One person s in US he is not taking any action and otjer person residing near hy blindly supports tat maintanence guy bcoz of the good rent he is getting and he is also telling that its his apartment he will leave to tent for any one
13 wanted to know if i can legally evacuate them since they are using it for commercial purpose.
14. They have stored water cans in common area and selling it across other apartments
15. Will this service apartment comes under commercialisation
16. Can we ask them to evacuate sinecall other three families ate jot okay with it?
17. Will it be legally correct?

Conveyance in case of partial occupation certificate

Dear Experts,
Ours is housing society in thane with 54 flats. Now the builder has paid penalty under the amnesty scheme to avail OC. However, there is some legal issue in case of 2 of the above flats. Hence at present penalty has been levied and OC will be given only in case of 52 flats.
Ours is federation of 5 societies. Now all of us have OC except that in our case its a partial OC.
My questions:
1) Whether we, as a federation, can go ahead for conveyance
2) Whether the other 4 societies can go ahead for conveyance after excluding us. We share common land and common compound.

want separation with wife

Sir/madam,
I am 43 yes old male from jaipur wanting separation from my wife from Lucknow.
Due to cultural difference, she is not willing to adjust to our ways of life.
She is uncooperative with my family and does not provide a helping hand in the house work except for caring for her daughter.
Whats more is that I do not have any employment now.
In daily quarrels, she invariably taunts me on my unemployment which is getting louder by the day.
After all the arrangements that I do with help from my father for my wife and daughter, she just does not appreciate, acknowledge, cooperate or compassionate.
I do not have any family life with her since 2008 nor do we share the same room.

I know that whatever I have will go to my child whom I love very much and want it that way but I just cannot live with my wife under the same roof.
Daily quarrels are killing me.
Please help me.

Forcefully occupation of the ground for political event

Respected Experts,
The undersigned seek your expert advise on below sated issue.

We have a Federation consisting of 27 co-op.hsg societies in one housing complex. The federation looks after the daily affairs of the complex. There is central play ground which some times allots to the social functions as per list prepared and approved in the AGM of the federation. Since 1991 till today the federation has maintain peace in the complex and not giving said ground for any political event.

This month one political group/party has approached to the federation for the permission of the ground to conduct their political event in the ground, which is refused by the committee of the federation.

The event organizers (belongs to politicians) have started threatening to the committee members by saying that they will conduct the event forcefully without permission on the said ground.

Please advise suitable precautions to be taken or action to be initiated against them.
