As per the below mentioned procedure i wish to know as to what is the minimum time frame between first and final notice served to member before approaching the registrar.
say i serve first notice on 1st june. when can i serve the second notice and after that when can i approch the registrar for a recovery certificate.
Society should issue a notice for the payment of dues (including interest up to 21%. Show the principal and interest separately in the notice) to the defaulter with a warning that on failure to make the payment as per notice, the society / managing committee has no option but to move an application for recovery under Section 101 of MCS Act,1960 to the competent authority.
Even after the reminders / warning if the member does not pay the same, pass a resolution to recover the dues under Section 101 of MCS Act’1960 in the Managing Committee Meeting.
Issue last and final notice to the defaulter
the tenure of the previous managing committee is over few months back. we are told that due to covid , elections cannot be conducted. but in our society of the three office bearers,
one had sold the flat and gone
other is not in mumbai since last yr lockdown
third cannot give time
so since past one yr no one is actively involed in scoeity management. we wish to hold elections asap. please guide how to we go about it . is there still any restrictions?

My father purchased a land in his name around 30 years back.
I have constructed a house on the land with his consent jointly ( approx 30 % by father and 70%by me) around 20 years back.
Now my father wants to transfer the total property in the name of my brother.
I am still residing in that house.
My brother reside in a separate house which which was purchased in the name of my mother (dead).
My father and my brother repeatedly pressurise and threatened me to vacate the house where I reside.
At the same time my father asked huge money form me for equal partition for the land owned by my mother ( dead).
Myself repeatedly tried for amicable settlement, but they didn't agree for any peaceful settlement because my earnings is more than my brother.

I and my 2 other brothers had agreed to the partition of the land accordingly and it is written on a stamp paper with 2 witnesses attestation but we had not notarized the stamp paper, now is that agreement valid?

Our building is located in Mumbai Western Suburbs, its old structure which we are planning to get redeveloped. It has come to our notice that the Property Card of our society is not updated, the redevelopment builder is saying he would get it done. I have couple of queries
1. What is the relevance of Property card
2. Is there any risk involved in getting the property card updated by the builder or should we as a society go-ahead and get the property card updated.

My grandfather wrote a will to me (as my father died long ago) in his own handwriting but there are no signatures of witness so the only other successor will be my aunt (father's sister) whom i think will agree to the will.
So can this will be accepted in court as there is no one other who is claiming.

I have joined a Public Sector Bank as a PO last year. Though I applied as EWS, I got selected as a GENERAL MERIT candidate with final marks higher than GENERAL cut-off.
However, recently my father confessed that he gave wrong details in the EWS application form while procuring the EWS certificate in 2019. Even though my EWS status is genuine, he provided wrong information as he thought the correct information will lead to cancellation of application. Thus the supporting documents don't match the reality back then.
Given my selection under GENERAL merit and genuine EWS status, will I face any criminal case in future if it is revealed? Should I resign?
Any advice will be very helpful.
Resignation during probation period

I am working with a IT company, India since January 2021 and currently am on probation for 6 months. I am resigning due to bad management policies and got a better offer received from another company.
When I put my resignation, i am asked to serve a notice period for 3 months. The offer letter does not state a different clause for the notice period on probation.
As per my offer letter,
Probation Period:
You are required to serve a probation period of 6 months from the date of joining, after which you will be issued a confirmation letter if your performance is satisfactory.
Notice Period upon Employment Termination:
The Company or the Employee may terminate this contract by giving Notice in writing to the other of not less than 3 Months. Enforcing the option of the notice period is entirely up to the management.
In such cases
1. what should I do as they are not agreeing any thing else.
2. What will happen if I forcefully stop working in that organization in one month time by handover all the assets which I am having.
3. Will they file any complaints against me and stop my career throughout my life.
4. Is 3 months notice period legally valid during the probation period.
