Partition deed without having title.

X has filed a civil case for specific performance suit vide O.S.No.291/1981 on the file of District Munsiff, Hyderabad for allotment of an extent of Ac.12-03 gts ( from out of total extent of Ac.20.11gts) and after entering into a compromise by both the parties in the said O.S.No.191/1981., before the court. And they further informed, the said court finally on 29.12.1981 Passed a Final Decree in favour of X, by allotting an extent of Ac.12.03 gts in Sy.No.56 in the name of X. And X updated his name only in Pahanies that too in Possession column, as possessor in the revenue records of Mandal Revenue Office, as per the court compromise decree.

X never filed any Execution Petition for enforcing the above Final Decree, which was passed in his favour on 29.12.1981, before the Court. till now no Execution Petition filed to get the title in his name.

On 30-08-2014, the family members of X, have executed a Registered Partition Deed vide document No. 6345/2014 of SRO,Rajendra Nagar on the basis of the above said Final Decree dated 29.12.1981, Now they are registering sale deeds basing on Registered Partition Deed.

Q1. Is partition Deed valid or not because it is based on Court decree and Court decree itself is un-executed
within a stipulated period of 12 years.?
Q2. How should i cancel the Registered Partition Deed ?

Invoking of Section 209 of IPC in term of the judgement H S

Can application be filed for invoking Section 209 IPC can be filled immediately after receiving written statement by the defendant in view of the judgement of HS Bedi Vs NHAI.

Stay

I filed quash petition in High Court unfortunately stay has not granted
Now i am filing petition in lower Court under Section 407 (6) CRPC read with 309 CRPC.

Section 407 (6) CRPC : "Where the application is for the transfer of a case or appeal from any subordinate Court, the High Court may, if it is satisfied that it is necessary so to do in the interests of justice, order that, pending the disposal of the application, the proceedings in the subordinate Court shall be stayed, on such terms as the High Court may think fit to impose:
Provided that such stay shall not affect the subordinate Court' s power of remand under section 309.

OR

If Not

What is the provison to lodge stay petition in lower Court in respect of NI Act case

Proof of delivery of notice of agm

1. Whether proof of delivery of notice of agm is required to be kept?
2. What is the proof of delivery of notice sent via courier?
3. If courier does not come back, is this a sufficient proof of delivery to recepient?
4. Whether denial of notice of agm served by hand shall be treated as notice served? Director after reading notice of agm returned and denied to receive it.

Transfer petition in divorce case

Dear Sir
I have filed Divorce case from Gurgaon court
Wife from Bhopal and she filed Transfer petition in Supreme Court
Supreme court has granted stay order for Gurgaon proceedings and issue notice to me to reply

Already 498a and DV case is in bhopal and we have got stay orders from High court jabalpur in both cases
Want to understand the further process in supreme court and can transfer be easily done
How can i contest it

adverse possession matter

hello, i need help on a matter of my home where we r living from last 70 years, our owner is dead since 1975 and she doesn't have any kids also her husband is dead, so we r living in home who has no owner and we have legal possession since 1960, we paid rent until owner was alive, but after she died there's no one to collect rent, so now i heard about adverse possession act and i guess we can claom ownership under this law..also electricity and water bills are titled under our family name since 30 years.. so i need some advice about this matter.. thanks
