Stage of argument

My case is running in family court since 2016.Currently judge passes no cross order and my case came on this stage "argument of exh " I want to know what does it means argument of exh ....

Cr p c 340

I have two queries

1) In CR P C 340 application whether judge can dispose application with only finding ?

2) Cr P C 340 should be disposed first and then any application etc. but if this sequence is not followed what will be legal consequence ?

Capital gain tax on sale of gifted land

R (aged 71) has a vacant plot measuring 2400 ft in West Chennai which was purchased in 1975.
N (79) his elder brother has a residential property of 2600 sft with built up area of about 1500 sft in East Chennai. It was purchased in 1974 and 50% of the property was settled in favour of his wife L in 2015. They want to demolish the house and construct apartment building there.
Now, if R executes a gift deed of his vacant plot to N and afterwards N sells it and reinvests the proceeds for construction of 4 flats in the premises jointly owned by N and L what will be the implications of Capital Gain Tax for N.
Whether N will get exemption of the construction cost of all the 4 flats or for one flat only?
Whether Settlement deed is preferable to Gift Deed?
What will be the obligations of R as donor under IT Act?
What are the other charges /expenses that may be involved?

Non payment of Incentive

Dear Sir,
I was working as DSE for a distributor for last 24 months but last month the distributor abuses me & asked me to leave the job even i was agree to quit the job & when i asked for my salary of 1 month & incentive for last 24 month he abused me & refuse to give my incentive of last 24 months before that when ever i asked for incentive he delayed me to give but now when i am ready to leave the job he refuse my incentive. Sir pls help me to get my iincrntiv

Departmental enquiry ..... audio recordings

Some of the allwgations have been framed on the basis of audio recording. But mobile device on which recording was done not seized by the investigating officer, not kept in safe custody duly sealed. In stead of mobile device, CD was presented in the proceedings on which Inquring Authority (IA) passed the order ' Accepted as record. Source and authenticity to be proved'.
Now the prosecution is not having mobile device in its custody ( it is in the custody of the complainant for the last 3 years when complaint was made), PLEASE advise whether this evidence can be relied upon and accepted by the IA

Property issue

Hello Sir

We are Hindu family of 3 brothers and from agriculture family background. 10 years back my father sold our ancestor property of 3 acres dry land and bought 3 acres in another place and registered in my elder brothers name. Now my elder brother is not ready to share the property claiming it is on his name and not ancestor property. My father is shocked and helpless.

Could someone he us to understand according to law my father cant do anything? Is there any way I can do on this?

Please advice us.

Need judgment bombay high court in case of cit vs. godavari

Dear Sir,

Please share with me the order judgement "Judgment Bombay High Court in the case of CIT vs. Godavari Saraf"

"Judgment Bombay High Court in the case of CIT vs. Godavari Saraf held that until contrary decision is given by any other competent High Court, which is binding on a Tribunal in the relevant State, it has to proceed on the footing that the law declared by the High Court, though of another State, is the final law of the land. Which means that once a decision is given by any of the High Courts in the country and there is no contrary decision by any other High Court on the same issue then such decision of High Court will be binding on all the administrative authorities and Tribunals through out India."

hanafi law of inheritance

Share of Widow and 2 daughters in Husband or fathers inherited property..

A person died leaving behind a widow and 2 daughters he is entitled for some1/3rd share in inherited property from his Grandmother through his died mother .

what will the share of widow and 2 daughters, Is there any residue will be left or widow and daughters are entitled completely to the property inherited by their father or husband.
