Pension in case of disciplinary proceedings..

Ld Counsels,

If for an employee of state govt displinary proceedings are taken,
will it always be the case that pension for him will be stopped irrespective of the punishment in the displinary proceedings...

In what circumstances pension will not be granted for an employee who has worked for state dept for more that 10 years.

Pls clarify

Writ Petition with SEBI as one Party

Dear Members,

Can anyone enlighten if I can initiate a writ petition in the High Court of any state against a public company with SEBI as the other party.

Is there any jurisdiction for initiating W.P against SEBI.

I want to know whether offence of Gambling falls in category of moral turpitude and what will be the impact on the Govt. Job of my friend who is a teacher and he is facing a gambling case,in case he declared quilty by the court.Thanx Regards

Consumer Court Case of Electricity Department

1. My father has filed a suit against the wrong bill made by the Electricity Department of the City in 2000. Up to now this suit has been pending and no order and judgment has passed against anybody.

2. Now in July 2009 my father died. So the suit which filed by my father will be closed by giving a death proof in the Consumer COurt.

3. Will the recovery of the Bill have any liability to me to pay of the father.

Or The Bill amount will be gone for waiver because the owner has died who bill was outstanding.

Or
I have to make a legal representative to contest that suit on behalf of myself.

4. In which direction I 'll have to proceed ?

Defacement act

there is a police complaint filed against me for property defacement- law of maharashtra, offence is cognisable, non bailable.please suggest easiest way of getting out of trouble.

Reg child adaption

My elder brother was brought up by my paternal aunt(My fathers sister and her husband)as they do not have children for almost 15 yrs in their married life.

They took my brother when he was in the age of 3 yrs and brought him up till his marriage. Almost after 10 yrs of growing my brother my aunt was blessed with 2 male children. After getting their children they kept my brother aside and even they didn't give him proper education also. As he was accustomed to that environment he was unable to come back to my parents also.

My uncle provided good education to his both sons and now they both are well off. 6 yrs back my aunt also left the world. But my brother is leading a horrible life with out getting any support from them and neither he can not come back to my parents also. And my brother got married and gifted with 2 daughters and he faced problems in his married life and got divorced.

Now the problem is my uncle at the age of 69 is going to marry again.

Even they took my brother there is no adaption documents with my brother. But in his education certificates my uncle name is mentioned as my brothers father.

My doubt is:

Eventhough my uncle got good properties will he get any rights on his property or not?

Can he claim any thing legally b'coz his position is worst when compared to the other 2 sons of my uncle?

As I said earlier my uncle is going to marry at 69 yrs his both sons are planning to approach the court of law for the properties. in the same way whether my brother can do any thing?

I need a proper suggestion in this issue, experts please help me out to relieve my brother from his financial hurdles as well as his family hurdles.

Negotiable Instrument Act- Indorsement

Want to know that where drawee of crossed cheque is compnay then who can indorse the cheque. As per act, by writing and by putting signature on the back of the cheque, indorsement can be effected. In case of compnay how it can be done, can it be done by merely putting compnay seal on back of the cheque or by putting compnay seal as well as compnay authorized signatory signature.
