Inheritance of immovable property

Respected Sirs,

My father died intestate at Bangalore in 1970, leaving behind his wife, five sons (including me) and one daughter. Presently, my sister and I are the only surviving Class I legal heirs; however, my sisters-in-law i.e. the wives of my four brothers are alive.

Today, i.e. almost 48 years after my father’s death, I came to know from our family friend, who visited Bhatkal, that as per the relevant Official records, some land situated at Bhatkal, admeasuring 2 acres, which was purchased by my father long back, continues to be in my father’s name and that someone who was interested in the said land was making inquiries about it and that he is now trying to encroach upon my father’s land.

Till date, no one in our family was even aware of the existence of the aforesaid land owned by my father.

Kindly advise me and let me know what immediate steps the legal heirs should take to protect the said property and to get it transferred in the name of the legal heirs.

Transfer of criminalcases

What to do to tranfer a criminal case from the court of the add.c.j.m. to any other court if the said add.c.j.m. is in the charge of the c.j.m. as c.j.m. is on long leave ..?

Divorce Certificate

Hi. I'm from Mumbai. I got divorced two years back. I want to know if I can apply for a Divorce Certificate online. If not, how do I go about it? I have the final decree from the court. Am not in touch with my lawyer so I'd like to do this myself. Please advise. Thanks!

ACB on 498

Respected Sir my wife has filed a legal case against me against 498 and FIR was registered in 2017 I receive Notice from local Thana under section 41a to appear and as a part of Investigation now have APPLIED anticipatory bail and judge has grant 3 days notice period so will that be considered as approval of anticipatory bail or do I need to apply again for the same please give clarity on this

Got a scn from passport office

My name is Nishant Tiwari and I have applied for fresh passport on 15/01/2018 and appointment was at Ghaziabad on 17/01/2018.

I am working in Indian Oil Corporation (PSU) Mathura refinery and living at IOCL township since November 2015. I have been issued passport with File no GZ1061911163418 on post verification basis on 1st Feb 2018 on behalf of duly signed "No Objection certificate" from higher authorities of the corporation.

After receiving my passport I had gone through police verification and submitted all the required documents including my current address proof issued by Indian Oil Corporation. Recently, I have received a SMS on 19th Feb on my registered number stating that "Police has submitted adverse report for your current address". After getting this SMS I have tried contacting Ghaziabad passport office authorities on contact numbers given by customer care but no one received the call.

Capital gains

I acquired the property in year 2000 for 6 lac.
And sold in FY 2017-18 for 120 lac. The circle rate is 62 lac and the valuation as per Regd. Valuer is 70 lacs.
Can 1 consider the cost of acqn as 70 lac.?

And capital gain of 50 lac ( 120-70)

Purchasing an apartment

Hi Sir/ Madam,

I have booked an apartment in Chennai within cmda limits. The cmda plan approval copy shows the unit size as 453 sq ft only but the actual build up area is 885 sq ft. This is an under construction property. When I asked about this to the builder he said that they will need to get approval only for no.of kitchen and the unit size can vary.

The construction is being done in 5 grounds of land in the 30 feet road. The total land is sub divided into 5 part with a passage of 16 feet road.

I have booked in the block B which has a 16 feet road.

Is it okay to purchase this property.

Experience certificate issue in govt deparment

Hi,
I recently got recruited in a government job (defence sector) as an Upper Divisional Clerk. As an essential requirement it had asked for a minimum 2 year experience anywhere as a Lower div. clerk or 3 years in Office management.
Now that a few years back I and my brother had registered a startup (pvt ltd) with both of us as directors and within a year it was shut down due to sustainability and failed revenue model (we didn't even file returns). I used an experience certificate of the same company here for 3 years.
Now, since I am to undergo a background verification which I believe will also consider this company? Now since we (me and my brother) were directors, how are they ever going to find out the details and whether it would affect since there is no valid point to reject the fact that I had an experience of 3 years as a company. Little confused over this. Or should I reject the offer if its going to be problematic? Because I have nothing much to lose here.

Status qua

Hi there i have a query about status qua interim injunction i field a suit in September and lower Court passed status qua interim injunction order till 1 12 2017 after that day my counsel forgot to ask for extension of stay order is there still status qua order on that property or do i need a vacated order from court for registry of plot thanx

Purchasing a flat on part payment

Dear Sir,

I have approached my friend to buy his flat located in Bangalore, he agreed to sell the same and due to our close friendship, I proposed him that I will pay part payment initially and occupy the property, and the remaining payment will be made in a period of 24 Months.

I told him that, once I pay him the full payment I will get the flat registered on my name.

In the above scenario, what agreement should i enter with my friend?

Is it an MOU, or a sale agreement or is there any alternative.

Please suggest.
