Mother's property rights

Dear respected experts,

After my father's death, the property was transferred to my mother, and we are 3 children, 2 sons and 1 daughter ( married). My mother now wants to dispose the property , what could be the division of share . Your advise is highly appreciated. ( We are Sunni muslims ).

Transaction of a land

Hi,

I am looking to purchase a flat in apartment that has been built on 3 plots.


Background:

1. The 4 plots were bought in the year 1988.
The 4 plots has been involved in land grabbing issue in 2015 and were sold to someone using fake PoA.

2. In 2021, the real owners of the plot filed a case and settled in terms of a compromise memo with the defendants. The same has been recorded in the District Munsif court.
3. As part of compromise a plot was provided to the defendants. The fake documents like PoA and sale deed (registered during land grabbing 2015) has been declared as Null and Void by the District Munsif Court.

4. For the remaining 3 plots, the real owners has given GPA to a builder to build the apartment. It's a 5 storey apartment and around 10 registrations for the flats have been completed.


- My question is, can there be in future any issues, where the defendants claim for the plots?
- The builder has a good reputation in the area and says all the issues were already resolved.
-
Could the defendants cause any issues in the future? Is it safe to proceed with the buying of flat?

I consulted a lawyer and he says, since the compromise has been made, the defendants cannot claim anything in future. He says any 3rd party can claim, however that will not have any significance. So I can proceed with buying the apartment.

Please let me know your insights.

Court hearing and order without my reply

Madam/Dear sir, I feel the judge handling my case is biased against me, as she openly told me that "i know what r u and i also know hoow to deal with people like you". She has finalised my crpc 125 within 1 month and within 5 dates. In that too, 1st date and second date had enough time between them (23 days) after that she put dates within a week and gave final order. I requested here for longer dates as i travel from around 1200 kms, i also requested her for setting aside the ex parte order. She declined everything and without presentation of my WS or reply she just gave final order with 35000/- as monthly maintainence. I dont do job, my wife do not have child, i dont know how to go ahead? Is it possible to get relief from higher courts or shall i just loose hopes and wait for my arrest for not paying the maintainance as i know i cant.

Eviction suite related query

My son got married 7 years ago in 2015 and since begining the daughter in law was very abusive and treated me and my husband very badly. She always wanted us to stay away from our son. We stayed only one year in 2018 along my son and daughter in law during which we suffered a lot of harrasment and I was subjected to beatings also by daughter in law as a result my husband passed away in 4 years back due to the stress. My health also has gone down after his death.
Police were not doing anything and had asked us to move out of our house to avoid further torture. We did the same.

That time in 2019 we were in dilema to file dv case or divorce case against the daughter in law.
As per our lawyers suggestion 3 years ago in 2019 my son had filled a divorce case against his wife and now the court has granted her interim allowance of 20% of my sons salary. My son has no child.

The flat( purchased by my son and his father with their own earned money ) in which daughter in law is staying was earlier in my sons name during his marriage and he transferred it to my name in 2019 before filing the divorce case. This was done as there was constant presure by daughter in law and her parents to transfer the flat in her name.
My son and I stay in rented flat since last 4 years and the daughter in law is staying in my flat.

Now our lawyer is suggesting me to file eviction suite to get my flat vacated from daughter in law as the court has granted her ia.
If we file eviction suite and daughter in law files dv against us then will the court stop us from evicting her from my flat?
How do I get my flat vacated?

Due to my down health can I file dv case against my daughter in law using a power of attorney i.e. my son?

Ancestral land transferred without daughter's consent

Hi Dear Experts,

I am living in Haryana.
We are 2 brothers and 2 sisters.
We have some ancestral land that my father got from great-great-grandfathers.

My Father transferred all the Land in the name of my 2 Brothers and told me and my sister that we don't have any share in the ancestral land.

1. Do we have any right in this ancestral land and how can I and my sister get the share in our ancestral land?
What is the procedure?
Can the daughter get her share if the father ( KARTA) transfers all the ancestral land in the name of Sons only without any consent of the daughter?

2. Nowadays, Are daughters getting their share by following the process of Law?
Is it fruitful to file a civil case for daughters to ask for a share in the court?
