Sir,
Plis provide me if there is any court ruling for review of DPC for promotion due to delayed DPC similar to the case as below:-
1. I joined the Dept of CBEC in the grade of Tax Assistant on 08.09.2010
2. I was promoted to the grade of Senior Tax Assistant on 7th May, 2014. The DPC for promotion to Senior Tax Assistant was held lately even though I was eligible for promotion on 1st January, 2014. As per DOPT's model calender the DPC for promotion is to be held 4 months before the commencement of vancancy year i.e January 1.
3. Due to delayed in convening my promotion to the grade of Senior Tax Assistant I was not eligible for promotion to the grade of Inspector as on 1st April 2016 even though I completed 2 years regular service in the grade as per Recruitment Rules of Inspector in CBEC. Crucial date for eligibility for promotion was revised by DOPT in the year 2014.
In this regard, I need papers or court rulings for review of DPC due to delayed in convening... if you can supply the same I would be very thankful to you
