Partition of property

My mother died three years back leaving me, my brother and my father.
My mother has a land purchase by her.
After death of my mother my brother and my father wants to make partition in such a way that I will get worst part of the land.

They also want to register the property in their name.

Sir

Can co-owner of a ancestral property registered without concent of one owner (myself). ?

How to stop such action ?

Proof of possession of a property

Sir
Kindly give the reply with applicable law if any.
A person who had obtained an electricity connection on the property of another person by way of a forged document later vacates the property. can claim possession of the property after vacating the same on the basis of electricity bills which are left unpaid by him while vacating?

I mean: Can unpaid electricity bill be used as proof of possession after the date when he had vacated the house?

Joining adjacent plot

Can two adjacent plots be joined without the permission of the other? I am talking here about common wall. Guruprit has one plot. Hanspal has the other.

In Guruprit's plot, Guruprit lives on the ground floor while Hanspal lives on the first floor. Stairs to Hanspal first floor and the common terrace have been constructed partly in Hanspal's plot.

Can Hanspal consider it a common wall and construct a house around those stairs in his own plot, without Guruprit's permission? 3ft area has been used in his plot as stairs. He is wanting to extend a whole hosue around those stairs. Can he do that? Can Hanspal carry constrution activities in Guruprit's plot?

Our new home on grandmother's (alive) plot

We have constructed our new home on our grandmother's plot, given to us by our grandmother. But the housework has just finished and the paperwork has not been done. It was all verbal up till now. She gave us the permission to go ahead and we went ahead with it.
Can she backtrack on her decision once the house is complete? She has kept us in confidence uptill now. We are wanting to get the paperwork done now but other parties (elder brother and his family) are influencing our grandmother and blackmailing us and her in various ways. They had no issue before the house was being constructed but are now getting jealous and taking interest in this matter.
Can grandmother go back on her decision and not sign the document? Can other members claim share in the house which we have constructed using our own money?

ग्राम पंचायत गैर मलकान हरिजनान

मेरा गांव में एक 60 गज भूमि पर 25 साल से कब्जा है मैं वहां पर पशु बांधता हु , जिसका जमाबंदी में मालिक का नाम कॉलम में ग्राम पंचायत गैर मलकान हरिजनान लिखा है, अब गांव के हरिजन उस जमीन को हरिजनों की सामूहिक सम्पति बता कर खाली करने की कह रहे है , कुछ गांव के लोग उसे ग्राम पंचायत की भूमि बताते है कृपया बताएं उस जमीन का असली मालिक पंचायत है या हरिजन ओर कोंन मुझे कब्जा छोड़ने को बाद्य कर सकता है

Area value in patta is wrong when comparing to field map

Hi,

My father is having an ancestral agricultural land and has been doing farming on that, recently while he was trying to transfer the property to my name he came to know that there was some difference in area value in Patta comparing with Field Map. The area in the field map is 63.5 ares and it is correct as per the actual land area, but in the Patta document it is mentioned only as 6 ares. Please let me know how to get this corrected.

Selling partial rights of my property

Because of capital gain requirement, my father needs to buy a property. I have a flat in Navi Mumbai.
Please let me know (a) if I can sell 70% of ownership rights of this flat to my father against sales consideration to fulfil capital gain requirement (b) In that case, how does society treat this transaction? (transfer of ownership or no transfer) . Thank you in advance for your kind guidance.

Getting stay against cmrl land acquisition

Dear Sir, Chennai Metro rail at Koyambedu has started to build elevated bridges in Porur via duct, chennai. They have issued noticed to us saying they need 68 Sq/m land for acquisition. Then in their second notice, they extended the measurement from 68 Sq/m to 99 Sq / m. Our land is 2400sqft. Based on their measure, we loose 1010 sqft. We have raised complaint in PM and CM greivance cell. But i received a letter that appropriate action will be taken but still nothing happened for one year. We built shops in our land for our livelihood. My dad is owner of this land is 80 years old and no other house/land we have. There is another way where they construct bridge without destroying our houses. Can we take the another route to court and get stay order from court? Or any other way to stop land acquisition Sir. Please reply.

Neighbour creating problem by doing business in home

Hi,

My neighbour is converting the home which is right beside my entrance into a restaurant, the smell of cooking is creating much problem for us to stay even inside the room also. Even the customer are making dirt outside of my house after consuming product from this restaurant.

Suddenly they changes there balcony in ground floor into a restaurant.

What steps I can take to resolve this problem? Please help me urgently.
