Dear Sir,
We few of the residents staying in gated community flats at Hyderabad have been asking the builder to submit all the relevant documents to the gram panchyat enabling us to pay our property tax and to show us the detailed accounts since the owners association has been incorporated, as we are paying our monthly maintenance. This we had been asking since las more than a year now. He also wants to increase the montly maintanence to which we asked him to show the accounts to know if the increment is justifiable or not. To this the builder has put civil case against 12 residents in the month of Jan. 2011 stating that we are obstructing the workers from carrying out certain works and informing the propective buyers about the issues prevailing in the society. Now this month he has filed another fresh Criminal Case mentioning the same points against 4 residents whose names are also figuring in civil case. Out of 4 one of the resident has been residing in London since more than a year now. Sir, kindly guide us as to how to take it up as the Criminal Case has been filed under section IPC 500, 190 and 200 and we know all this is false case and he may also bring wrong witnessess. Kindly guide us. Regards, Jay

As the opposite party has already filed a case against you u/s 500, 190 and 200 of I.P.C. at first you will be require to appear before the trial Court by surrendering your self and pray for bail then contest the case according to its merits i.e. what are the contentions of your other side and in reply to the same what are your defense etc . Alternatively after obtaining the certified copy of the complain if you consider that their is no merit at all you can file an application before the Honorable HIGH COURT u/s 482 Cr.P.C. praying for quashing the said case and if the Honorable HIGH COURT is satisfied with your contention Honorable HIGH COURT may quash the whole proceeding.
