I had booked a flat and builder is asking for parking and facilities charges as per the allotment letter.
i recently come to know that builder can't charge for parking and facilities, according to SC judgment (SEP 2010).

address letter to builder enclsoing copy of judgement and request him not to charge you for allotment of car parking slot . if he refuses you can move consumer forum for deficency in service

I have read the attached judgment of SC. Please correct me if something i have wrongly interpreted.
Open/stilt parking comes in cost of flat. So, Builder/promoter can't charge for parking as a independent unit or along with the flat. But, he can proportionately include cost of parking in flat's cost
This judgment has nothing to do with common area and facilities charges??
As per the judgment, builder can't charge now for parking even if he has mentioned the parking charges in the agreement done at booking i.e. before the judgment??
In my case, builder had not mentioned the charges in the allotment letter. But had mentioned that he will charge at possession according to the type of parking selected in the booking form(i had selected open parking).
According to me, as per judgment i should not pay the parking charges and i should pay for the other facilities charges??
Please guide me!!
