Builder not giving possession letter or noc to re sale the flat

Respected Members,
I have paid full amount for a flat to the builder and I just have allotment letter for that flat. Now, I want to re-sell the flat as soon as possible but the builder is asking for 12lakhs for giving me possession letter and NOC, even though I have paid full amount for that flat to him.
Can I sell my flat without having a possession letter? If No, what is the best way to solve this problem?

if you have paid full amount why has builder not executed agreement for sale in your favour . issue builder legal notice to execute agreement with you . dont be in hurry to sell now . you cna move consumer foprum for necessary reliefs

Dear Querist
the builder has no right to demand extra money from you, first of all read your agreement and if there is no clause regarding extra money and you have all the proof regarding your payment then you can file a complaint before consumer court against the builder and get relief from the forum. you can also file a suit before civil court under specific relief act.

Sir, I have allotment letter and I have completed all me payments but now I have to sell of my flat so how can I do it on allotment letter 'only'. What option do I have...I am not yet rejistered.

you cant sell on basis of allotment letter . in addition for transfer of flat you need builder consent .

You can either move to consumer forum or the civil court as advised above by the expert Nadeem Qureshi ji.

Litigation is time and cost consuming.

issue legal notice wait for agreement to be executed by builder . contact local lawyer
