Building permission for a plot sold in 2 parts after construction

Hi,

I am buying a property in Bhopal (MP) which was a part of 2400sq ft plot which the earlier owner has sold to a builder. The builder constructed 2 portion of 1300st ft and 1100sq ft and sold to 2 parties. He got only one building permission for the complete 2400st ft plot.

Now I am buying the property from one of the party the builder sold the 1300sq st constructed part.

I applied in SBI for home loan and they rejected the application stating that there should be a separate building permission for 1300sq ft area.

When I checked with a local lawyer he said that it's not possible to get a separate building permission for 1300sq ft now.

What is the possible solution to this. Is the building a illegal construction now in eyes of Municipal Corporation. What other problem I can have if I get loan from any other bank overlooking this issue. Please suggest.

Every building should be constructed as per sanctioned plan otherwise its construction is illegal as per norms and laws of Municipality. You skould apply to the municipality and should get the illegal construction as legalized by paying their penalty etc and only then you should move ahead because municipality is legally empowered to demolish the construction if the same is not legal.

does the constructed portion have occupation certifcate or building completion certificate . ?

since you are buying the 1300 suqre feet from seller ask him to obatin clear title of the property .contact a local lawyer . do not purchase the prpoerty other wise

For unauthorized construction, no bank would finance you. Visit Municipal corporation or engage lawyer and enquire about how to legalise such construction.
