From company
Our tax audit for the year of 2008-09 has completed and what ever was the tax liability we have paid against the respective defaulters. We have paid
M/s ABC Disposable Products tax liability separately before the finalization of the tax liability with the 25% penalty to avoid 100% after the order passed by the STO.

This fact was informed to the buyers as they were not position to provide C Form before the assessment of the tax liability.

Their accountant inform us on phone that they will pay the tax liability for the year of 2008-09
The buyers is completely unsupportive and not replying any email or our telephonic calls. Their accountant informed us that their CA has applied for the C Forms but not arranging any acknowledgement to support this claim.

If he had given any email commitment within the period of limitation i.e. prior to 31.3.2012 then on that basis you can sue him for recovery of the money. There are no other method to recover the money.

your concern must have asked C form from the other firm in writing, send legal notice and file recovery case for their default.
