Can a consumer forum order to return the amount

I filed a complaint against the builder for using low quality materials and non completion before consumer forum. construction is so poor and it is dangerous to live there. we pray the forum to order builder to return the amount paid for flate..... But Our legal adviser/ advocate said that consumer forum cant order the opponents (builder) to return the amount of the flate , forum can compensate only...... Is it True?
We are in possession of a flate of that building

Yes. only compensation will be given.

Since you have taken possession of flat so order for return of sale consideration is not possible.Forum can grant/award compensation and cost of litigation.

Consumer Forum cannot order refund but it can order compensation.

1. "IF" you prove vide a registered Civil Architects & Structural Engineers' survey & Test report, that the building is unfit & dangerous for human dwelling, THEN the relevant Courts could consider ordering for return of money and damages thereon.
