Can a plot be registered under indian registration act 1908 ?

Sir,

I had purchased a residential plot in a Cooperative Housing Open Plot Society in 1988.And had registered the same after due verification

The Cooperative Housing Society was registered as a Cooperative Housing Society under the Societies Registration Act.

I was asked to get the purchase documents duly registered with the relevant sub Registrar of the Revenue Department under which the Plot purchased by me fell.

The registered document clearly mentioned my Plot No. of the Cooperative Housing Society.

Later on I, who was serving in the Armed Forces of the Union of India, learnt that Haryana Government had declared the Colony to be unauthorised and irregular under THE HARYANA DEVELOPMENT AND REGULATIONOFURBAN AREAS ACT, 1975 and has acquired the Land under Land Acquisition Act 1894 in the year 2008-2009.

Kindly guide as whether it was not incumbent upon the Sub registrar in whose office/ jurisdiction the Plot with its number and description etc of the said Housing Colony registered ensure that the said Colony was not an un authorised Colony?

What are the remedies available to me.

I solemnly state that I never ever got to know that the Colony was unauthorised or my piece of residential plot was being acquired/ acquired

I may also mention that the plots to the left and to the right of my plot have been spared from acquisition! I have also learnt that the Secretary of the Colony- without my knowledge or participation had filed a case but lost. But his plot was spared from acquisition.

Are there any case Laws to help me lodge a Case and win it to get my residential plot back.

I am a senior citizen and had in my younger days planned to settle in my only piece of Land.

There is no preference to senior citizen in legal battle.

You kept a lot of silence since last many days. You might have filed a petition like your neighbours who got succeeded in saving their plots from acquisition.

Anyway, you immediately engage a local lawyer and file a petition and LA Act. You shall be awarded compensation and you can file a petition before DJ to enhance the offered compensation. Take advise of local lawyer.

rightly advised by Mr. Makkad...you have got a remedy of compensation under Land Acquistion Act...simultaneously if you have been cheated by the said Cooperative Society then you could have proceeded against them both under the civil law and criminal law.

engage some local lawyer for detailed analysis of your documents.
