Can a registered AGPA holder sell a property

(Querist) 11 March 2014 This query is : Resolved
Can a registered AGPA holder sell a property with out the signature of the original owner, because some one said that there are some supreme court citations which are saying that the original owner has to sign the sale deed even if the AGPA is registered. So please advise about this.
Devajyoti Barman (Expert) 11 March 2014
Yes, he can. Supreme Court verdict is binding on cases of special natures only.
T. Kalaiselvan, Advocate (Expert) 11 March 2014
AGPA has been empowered or delegated with the powers by his principal to transact with the property as per the circumstance, hence he can sell it without the principal's signature, the GPA deed will be clear to contain that the acts of the power agent shall deemed to have been ratified by the principal once it is acted upon.
