Querist : Anonymous (Querist) 14 October 2011 This query is : Resolved
Dear Sir,
Can I go abraod for employment if any criminal case is in the court?

Current Situation:
First Hearing is on 19th October,2011
I got VISA for Employment to Saudi.Departure date is 20th November,2011 for a period of 2 years.
Charged CRPC sections are 294b and 323.It is also a counter case.
What can I do in this situation?

Unless there is a condition in bail not to travel without out of India w/o the permission of the court, you can travel freely anywhere in the world.

Before going abroad ask your Learned Advocate to file exemption application u/s 205 Cr.P.C .

It shall be better if you get prior permission of court. touring abroad and serving abroad are two different things. You may even not be available on regular hearings in future so it may definitely create problems for you.

you can but only after caring two opinions put penultimate to mine.

You can certainly travel but if leaving for a period of 2 years than non presence on the listing date in court will result in bailable and later unbailable warrants being issued against you.
Advocate Bhartesh goyal (Expert) 15 October 2011
Better you seek permission from court before going abroad.
Sailesh Kumar Shah (Expert) 15 October 2011
As advised by most experts that you need to take permission from the court.
