Dear sir/madam,
I was worked in ISRO as Sci/Eng-SC. I have resigned the job and got relieved on June 2009. I have resigned the job to pursue my higher study (i.e.M.Tech). The same reason only i quoted in my resignation letter. Now i am studying M.Tech. And the course will be completed on June 2011. Now i want to join back to the department (ISRO).
Is there any rule is available to pursue my request, if i request to the competent authority.

Why not? However, you need to undergo the fresh recruitment process and cannot claim continuation of services rendered in the past as there has been a break in service. unless if your leave is granted in sabbatical grounds, which is generally not granted for education purpose.

Yes. Mr.Loganathan is right.

You can not join back to your previous job.
You have to go for a fresh recruitment process only. But, you may be considered as a person experienced in the same department.

Mr.Arunagiri is right. once an employee resigns from his job and his resignation is accepted. the relationship between that employee and establishment come to am end. in the present care, the person has resinged and even relived from the post. thus he has no right or lien on the job. however, if he is eligible and fresh recruitment process is starts, he can appears and can be appointed afresh.

Your services with ISRO upto June 2009 is one chapter which has been put to "THE END'.
Now, you need to open another chapter like a fresher and you know all the probabilities of getting job there and if at all if you get the job, you would be a new employee with all previous services erased to blank.

REGARDING RESIGNATION AND REJOINING KINDLY NOTE THAT.
1.YOU HAD RESIGNED IN 2009 FOR FURTHER STUDIES. HENCE YOUR EMPLOYMENT CONTRACT CAME TO AN END.
2.YOU WISH TO REJOIN THE SAID CO.AFTER COMPLETING YOUR STUDIES AFTER TWO YEARS,YOU HAVE TO APPLY FRESH AND IF SELECTED YOU CAN NEGOTIATE FOR HIGHER PAY SCALE MENTIONING YOUR PREVIOUS EXPERIENCE WITH THE SAID CO.IT IS UP TO THE MANAGEMENT TO DECIDE WITH REFERENCE TO SERVICE REGULATIONS, AS THEY ARE GETING TRAINED EMPLOYEE INSTEAD OF FRESH CANDIDATE.YOU WILL SUCCEED.
3.IT WOULD HAVE BEEN EASIER IF INSTEAD OF RESIGNING YOU SHOULD HAVE APPLIED FOR STUDY LEAVE,WITHOUT PAY, THEN THE EMPLOYER MIGHT HAVE CONSIDERED AND MAINTAINED YOUR CLAIM FOR THE SAID JOB WITH REFERENCE TO SERVICE REGULATIONS.
YOU MAY WRITE OR CALL FOR FURTHER HELP GOOD LUCK.

Respected sir/madam,
Actually i was told that even after resignation, a resigned person (within 2years from the resignation)can request for that earlier post which he had and that can be processed, in central government service rules there is provision like that and so.
Since the person who told me that very confidently, i want to clarify with you. But he is not an professionally administration person so he could not tell me the rule no and all.
Since you lawyers or administrative officers are very much know about the rules provisions available, please clarify me.

Dear Mr. Krishnamoorthy,
There is a provision for educational leave for a maximum of 2 years. But that facility is available only for Direct Recruit officers i.e. Group 'A' Officers and not for those below.
In any case, one has to take the approval from the department for proceeding on such education leave. After completion of the leave one can resume duties. While we do not know whether you were a Group 'A' officer, the fact remains that you resigned from your post. Therefore your friend is not correct in saying that one can rejoin the same post after resignation but within 2 years.

IN VIEW OF SUPREME COURT JUDGEMENT IN PRABHA ATRI CASE,REPORTED IN A.I.R. 2003, YOU ARE NOT ENTITLED TO BE TAKEN BACK IN THE SERVICE.

On the other hand, if my memory is correct, there is clear prohibition in the Central Govt Rules that a person who has resigned should not be re-employed ordinarily except for special reasons. You may pl check the recruitment rules of the Govt or the ISRO's rules if they have seprate rules. ISRO is a Govt. organisation.
