Can more than one investigation agencies pursue one offence under same section(s)?

Querist : Anonymous (Querist) 20 August 2011 This query is : Resolved
Hi Sir!
This person is a fraud?
We have already filed a money suit in DRT and have injected one of his property

He was FIRed u/s 120B, 420, 467, 468 & 471

He has been Charge Sheeted by CBI u/s 420, 467, 468 & 471 IPC

Thus as section 467 being under money laundering offence

A) can I request Directorate of Enforcement to also investigate and attach his properties and charge sheet him or start a separate criminal/ civil Proceedings under prevention of money laundering act?

B) Can 2 such cases/ investigation/ etc... run together for the same offence under same section in more than one form?

Please Advise!!

YOu can file separate civil and criminal proceedings always.

two separate agencies can investigate a particular matter simultaneously but within the limits of the powers provided to such agencies by the laws governing such agencies....

a particular criminal act may contain various directions and technicalities, so a specialist agency may play an important role in exploring the exact nature of offence....

further in case of multiple violations of law, different agencies have a duty to do trap such an offender....

No, two investigation agency can not investigate one and same complaint to the Police, if you are not satisfied with the Police Investigation, you may place application before the Learned Court for investigation other than Police on certain ground, and you may seek investigation by C.I.D.

it is clear that one complaint can not be investigated by two govt. agency.

thanks.

I agree. There is no provision that enables two different agencies to investigate simulteniously.

But one agency may seek help of another or the help of a wing of another agency.

I do agree with Mr. Kirankumar.
