Can my management refused me chance to appear in the examination?

Dear Sir,

I am working in a PSU. We have a carrier progression scheme for which I have the necessary qualification in regular course. Based on that qualification achieved I have appeared in the test required for carrier progression scheme but didn’t success earlier. We can avail total five chances. This year also I have applied for the test as third chance based on the qualification on which I have appeared earlier. But this time our Management refused me to give any more chance stating the reason that it was impossible for to obtain the required degree in regular course after meeting my shift duty in my organization. My university certified that I have obtained the degree meeting all the criteria including attendance in the college as per university norms. I don’t have any without pay also in my salary during the period required to obtain the degree. My head of the dept (HOD) also certified that it is possible to obtain a degree in regular course after meeting the duty criteria in shift in my organization. Still my Management didn’t agree to give further chance to appear for test required for the carrier progression scheme.
My question is that can my Management refused me to give me any further chance though I have only completed two chances out of five chances? If no, what shall I do now?

Usually it is mentioned that “Subject to approval”.

Before you agitate it shall be appropriate to download the policy and refer to its clauses.

Since the declination is issued by top management it shall not be out of place to observe restraint.

What were the office and your studies time? Were office and educational institution both situated at same place? Was it possible to attend both in normal course? If the matter is agitated by you before top management, management may order official inquiry and if some thing wrong found may start disciplinary proceedings.

Till all your defense is perfect, advised for not to agitating further. If all is OK, give representation through proper channel with advanced copy to promoting authority. Move through Association also. If no positive result, move to court.

Dear Sir,

Our office and educational institution where I studied is situated at the same station. Distance may be 4-5 kms. Study time is outside the duty hours also. As I work in shifts, so I have attended classes by changing my shifts.There is nothing wrong in my duty hours and University also certified that I have aquired the degree fulfilling al the norms of the University and there is nothing wrong also.

Obtaining higher qualification on part-time basis is not a crime but if you want to get its benefit in service, you need to get permission.
