Can NRI ( UK - Citized ) file Writ of Habeas Corpus in India for Custody of his Son?

If yes under which section he is authorized to do so?

YOU FILED AND IT FAILED IN DELHI HIGH COURT
AND YOU HAVE FILED APPEAL IN SUPREME COURT.
IN YOUR FIRST QUERY YOU ASKED ABOUT MERIT OF APPEAL AND I GUIDED YOU THEN TO DAY YOU ASKED IT WOULD BE TREATED A CIVIL OR CRIMINAL CASE AND NOW IT IS YOUR THIRD POST

Habeas Corpus won't decide the custody matter in any case.

It would just ask the police to produce the minor, and then the custody would be decided on different grounds.

PS: Yes, a Foriegn citizen can file Habeas Corpus in Indian HC
