Can open terrace be covered in apartments deed

(Querist) 17 July 2015 This query is : Resolved 
I had purchased resale flat in Pune
My flat is 2BHK with terrace over the flat
Old owner has covered the terrace with plastic sheets and also built one washroom which is covered with plywood
Now the society has given notice to pay 3 Lakh if we have to continue the covered terrace
Old owner was not having good relation with society chairman

Sir,

If you feel that you won't use the covered area, its better that you get rid of the same and mention that old owner was responsible for covering the same and when u have got the possession, you have immediately vacated it.

If you want to continue with the covered terrace, try to have settlement with the society and discuss the formula under which the amount is arrived and demanded.

For the period old owner used it he/she is responsible.

The rates charges from him/her shall be basis for new rates;;;;;higher or lower.

You want to retain it or not is your prerogative.

Why should i Vacant the terrace its belong to us now
We had purchased it
And terrace is covered since 4 years
Why they are giving notice today
And flat is in apartment deed
