Can we sell a property which is in our possession by gift

Querist : Anonymous (Querist) 27 April 2010 This query is : Resolved
Can i sell a flat which is in our possession by way of gift from ancestors. But no gift deed was made when the flat was gifted. We are residing here from last 47 years.
AEJAZ AHMED (Expert) 27 April 2010
Exactly you can sell, but upon production of any document regarding your relationship with the ancestor (on whose name house stand);

Upon production of death certificate on whose name house stands

If the purchaser is ready to proceed on the signatures of you all.

Further your query is silent about:
relationship with the ancestors
as you are saying in our possession, how many persons and who are you.
Querist : Anonymous (Querist) 27 April 2010
direct decendants of ancestor.
Raj Kumar Makkad (Expert) 27 April 2010
Gift should be established before proper court of law or you should follow the procedure told by Aejaz Ahmed.

What about a registered Gift Deed in favour of just two of the many grandchildren, got signed under duress from grandfather to circumvent succession by all heirs in the absence of any valid Will, without any knowledge of other legal heirs ?
