Cancellation of a flat

Hi experts,
I had pre booked a flat in a new construction in Kalyan. After a year now the construction has been on the same level as to when n how it was booked. I want to cancel my flat and feta refund for the same. I have paid 8lkahs for it.
The builder company says that it will take a year for the amount to be refunded and credited in my account. The reason for the construction to be still was not given to me since a year but now they say that there was a stay order from the kdmc and thus they could not proceed with it.
Should I wait for a year for the amount or should I go to the consumer court??
I am planning to purchase a flat for which I wanted this money.

You better go to consumer forum as there is no guarantee that after a year you will get the money back.
