Cancellation of registered sale deed

Dear Sirs,

Can you please let me know whether Is it possible to cancel a registered sale deed of property (Land in Hyderabad) if the payment is done through PDC and PDC is being dishonoured by the buyer later.

1. Yes, such sale deed can be sought to be cancelled as because the consideration of sale has not been realized since the PDC given by the purchaser has bounced. The seller (owner of the land) can seek such relief by filing a civil suit u/s 31 of the Specific Relief Act, 1963.

When the registration took place. As per present law payment made by way of PDC is not legal. Pl. answer.

Thx. Registration not yet done. Buyer wants to give pdc and go for registration. I am afraid if chq gets dishonored

Substitute PDC for DD or cash if you are consenting for regn.. The payment particulars forms part of regn. documents .
