sir i m working in Indian navy and i made an accident with a child in 2011 inside the naval campus. very next day case handed over to civil police and FIR filed against me by Navy(no member was involved from opponent party)after that i accept my mistake in the special court and court imposed a fine sum of Rs 2500 which i paid and case was closed in the month of Nov 11.Now after almost 3 years the child's father filed a petition in district court for reopening the case.
Sir my query is that ,the child father was not involved earlier for filing a case / FIR against me only Navy was involved.can he approach to next higher court for reopen the case ?

The defacto complainant can prefer appeal. However, please check it up whether the child's father has moved the court for seeking compensation as MACT laws or has preferred an appeal against the lower court's decision of imposing fine on you?
