Moonless night.The alley was dark due to street lights not working .Rajeev was driving his car along the alley. Rohit was walking in the middle of the road. suddenly, Rajeev's car hit rohit and hurt him seriously.Can Rajeev be Sued????

Yes, but Rajeev will have to prove the negligence of the injured person.

Suit Depends on the fact circumstances. Whether he was driving with head lights on?
Whether he used the horn?
Speed of the vehicle?
Condition of vehicle?
Whether he used the brake or not?

As you have said injured was in the middle of the road, it is contributory negligence, but driver may be sued for negligence also.

Yes case will be registered against the driver of the vehicle.

yes Rajeev can be sued i. e person driving the car is to be held responsible, though it is contributory negligence. but if there is negligence then rajeev has to prove it. otherwise he could be held responsible.
