Hi All,
I meet a girl 3 years back online, we become friends and fall in love relationship. Later she asked me to get married with her and was run behind me from long time. I asked her to knoe each other then will decide. After few months she was desperate marriage and planned everything with me. Things were quite good. Aftet few month she demanded some monetary help from me and as we are in relationship I gave her 25k via online transfer.
After few days I went to aborad for work and observe very unpredictable nature of her as she stopped communicating with me. I tried every anagle to get answer why she is not talking with me from long time. One day I called her and stick with question why its happening. Then she fought and broke with me without any single reason.
As soom this happen, I started getting abusing and threatening call from one guy who work in Indian army, that he will kill me, ruine my life if I try to contact her. I was shocked due to such behaviour from stranger person. I ignored and blocked him. As she ended this I tried to convince her to know reason of this sudden thing but didn't work. I call her to get my money back. So i tried to call her but never succed. She changed her no. Again that guy started abusing me and threatening me to kill to death if i try to contact her. Later this guy said they file case in army cell against me and also asked fake mumbai police to call me and threaten me that harresment case file on you in women cell. I was shocked. His threatening cycle still continueed.
I tried every way to communicate with her but didnt succeed. Later she filed false FIR in shillong against me saying " we r in talkative terms and recently I approach her for marriage & she denied it hence I started harresing her. Also mentioned "I used her identity without her concern in demo donation site I built to communicate with her"
I went to shillong and showed all proofs to Police, later case was dismissed as per evidences & our discussion.as per police notice she return my money back.
Threatening call from army guy still continued.. after few month I file NC-FIR against that guy at my city Pune. Police contacted him and gave instructions not to threaten me and close that NC.
After few days I again got call from guy saying "i created twitter account of her and they are going to log complaint in NIRBHAYA and PMO against me. I asked them to log complaint as I didn't did anything. Then he called several times, started abusing and told me that he will chop me in pieces and fuck my life n happiness in future. Such dangerous threat I faced which put me and my family in mentally devastated condition.
I changed my no. and then after few month, some fake person msg my all Facebook friend and defamed me that " I sexually harresed and molested that girl. Becareful from me" this was insance. I REPORT to police but they refused to take complaint as they said u should go in court to take action on this.
I still getting threats form that guy.
I want to take action on that army guy and girl who cheated, asked me to get married with her and took money and file false case on me.
Please suggest me proper way to file case against them in court

We really need help as we dont want someone to be victim of it again.

Are you afraid of this Army man? If not call him for meeting and settle clear terms with him to stop the daily soap drama.
Legally what you want to do?
File criminal compliant against him for criminal intimidation with threat to life u/s 506 IPC, so engage local lawyer and do it if you have sufficient evidence regarding all this against him.

I did check the website and saw the huge communication you collected there. You did send his Complaint to his Army department but no action taken. Make a formal complaint against him again to Union Minister of Defence with his complete record of defamatory communication with you and complete case history of no action taken against him for such indisciplined behavior with civilian while wearing Army color's.

Se unless a person has violated any provision of Army Act, no action is feasible by Army.
If it a crime only police will be able to take action.

Who will give clear info about army act. Today he again called from different no. and told to kill my entire family and Rape female members in my family. I recorded this already..pls help.. he is psycho guy. I called police they just askin to contact army and army ask to talk with civil. This is pathetic n becoming crutial mental harresment for us.

Police generally evades registering case against Army man befooling the complainant that they have no jurisdiction.
In the given circumstances he is committing only civil offense and no offense under Army Act. [atleast what appears from your post - unless you disclose more facts]. So there is no use writing to Army Chief or to the Defence Secretary or Defence Minister.
Give a written complaint to the police and if no action is taken meet higher police officers or file complaint before Ilaqa Magistrate.
Remember once FIR is registered then he is not getting promoted and if not promoted his length of service will be curtailed.

Let me clarify the offence of the Army man is covered under section 506 IPC as informed in my first post. Please read this section 506IPC:
Punishment for criminal intimidation.—Whoever commits, the offence of criminal intimidation shall be punished with imprisonÂment of either description for a term which may extend to two years, or with fine, or with both; If threat be to cause death or grievous hurt, etc.—And if the threat be to cause death or grievous hurt, or to cause the destruction of any property by fire, or to cause an offence punishable with death or imprisonment for life, or with imprisonment for a term which may extend to seven years, or to impute, unchastity to a woman, shall be punished with imprisonÂment of either description for a term which may extend to seven years, or with fine, or with both.
This is Non-Cognizable, Bailable and triable by the Magistrate offence.
The offence has to be reported directly to the Magistrate in the form of private complaint and not through police as registered FIR. The written complaint has to be filled in the court before the Magistrate under whose jurisdiction the offence was committed by the Complainant against the accused person who committed it. The accused person will be given bail and prosecuted on the basis of all the evidence that the complainant bring on the record for his complaint. The complainant has to bring on record all evidence he has at the pre-summoning stage and the same is used later for the prosecution of the accused person. The Magistrate may take the assistance of Police for investigation if required in the Complaint before it other wise the investigation is done by the Magistrate on the basis of the evidence brought before him by the Complainant.
Hope the brief procedure I explained to you is good enough to understand why Police refused to register your complaint, not because Police is afraid or in alliance with the Army personals but because the complaint you made about this man was covered under Section 506 IPC that is Non-Cognizable offence. The Police informed you to make direct complaint to Magistrate for this reason. The Cognizable offences are only registered as FIR under section 154 Cr.P.C and Non-Cognizable offences are referred to the Magistrate directly under section 155 Cr.P.C.
I told you in my first post to engage an advocate for directly filling the complaint u/s 506IPC against the Army man in the Magistrate Court for this reason.
I don't understand you people think as if experts here are all jokers (whereas, few are) and only misguiding you.

Agreeing with Mr Mahajan I would add that given facts indicate that:-
(I) You fell in love.
(II) she wanted to marry you
(III) at this stage you switched over to wanted to know each other
AS IF YOU FELL IN LOVE WITHOUT KNOW HER UNLESS YOU WERE ON FOR FREE ENJOYMENT.
(iv) You gave her thousands of rupees.
not clearing whether this was sale loan / gift / or sale price.
(V) You went abroad.
THEN WHY SHOULD SHE INDEFINITELY WAIT FOR YOU
(V) You broke up and you still wanted to contact her.
YOU DID NOT KNOW THE LATEST OFFENCES AGAINST WOMEN INCORPORATED IN IPC.
(VI) Then some male person who happens to be in Army had to step in.
YOU SAY THAT HE IS CONTINUOUSLY THREATENING YOU BUT HAVE NOT INDICATE WHETHER AT ALL YOU HAVE STOPPED CHASING THAT LADY ON PHONE.

(VI) Then some male person who happens to be in Army had to step in. YOU SAY THAT HE IS CONTINUOUSLY THREATENING, I DIDN'T CALL HER AT ALL AFTER I MEET HER FATER N SORT THINGS. Rather she called me and said Ill ruine your happiness as she said she got call from me which was totally unacceptable. I forget and forgive them long time but still that person doing this. I asked her father to log complaint in police but they didnt. Later my defemation on Facebook was so weired. And now yesterday night he called n threatening to RAPE female members of my family. He is such psycho person....
What else we can do for this apart from 506, look like she shared my addesss with him n thats why he was so confident to locate me
